Medico-Legal Tip of the day-21th Oct 2015
News in Indian express: New Delhi: The Delhi government has zeroed in on 89 hospitals and medical centres for reporting adverse sex ratio at birth in 2014-15 in its effort to check falling sex ratio in the national capital.
The government issued notices on Thursday to these hospitals asking them to explain the reason for the adverse sex ratio and whether they are following the rules under the Pre-Conception and Pre-Natal Diagnostic Techniques Act on pre-natal sex determination in 10 days.
Please advise –
1- Whether Govt of Delhi is likely to take some stringent legal action against these hospitals inspite of following the rules under the Pre-Conception and Pre-Natal Diagnostic Techniques Act on pre-natal sex determination
2-what these hospitals might do if Govt of Delhi take some legal action against these hospitals in future inspite of following the rules under the Pre-Conception and Pre-Natal Diagnostic Techniques Act on pre-natal sex determination
( Name of hospital withheld )
Answer- The govt may analyse birth ratio of male and female infants at hospitals. The hospital where unusually high male births are there , would come on surveillance. Such centres may have high number of abortions too.
But majority of hospitals who are not involved in illegal activities need not worry. Just keep records cleanly and honestly. Govt has power to cancel licence of hospital and starting criminal action against owner and doctors of hospital.
