DCI clarifies on mandatory State Dental Council registration while applying for vacancies, details
New Delhi- The Dental Council of India (DCI) has issued a letter regarding making registration with the State Dental Council mandatory while applying for vacancies before the examination. This letter has been written by the DCI, Deputy Secretary to the Health Secretaries of all the States and the Directors of all DMEs.
Through the letter, the Deputy Secretary, Vinay Gupta mentioned that the DCI has been receiving numerous requests from the dentists therein expressing their plight that while applying for permanent vacancies in different state governments, they have to get themselves registered in the respective State Dental Councils, which prohibits them to apply for vacancies in multiple states simultaneously.
Therefore, it has been directed to all the state governments in India to follow the provisions prescribed u/s 46(5) of the Dentists Act, 1948 and consider the inter-state or intra-state registration of the dental surgeons, dental hygienist or dental mechanic with any of the State Dental Council as per section 46(5) of the Dentists Act, 1948. However, your organization may, after finally selecting the applicant, ask to get his/her name transferred u/s 46A of the Dentists Act, 1948. This step will anticipate safeguarding the careers of deserving dentists across the country.
The DCI referred to its 2019 notification that said, "Some of the organizations functioning under your State/Central Government in their advertisement for filling up the vacancies under the dental stream have been incorporating the prominent condition of holding of registration from the concerned State Dental Council as one of the qualifying condition for considering of their candidature for appointment to the posts so advertised by such organisations. The Council feels that this is an incorrect position and is violative of statutory provisions of the Dentists Act, 1948 since as per section 46(5) of the Dentists Act, 1948, "any person who is registered dentist, registered dental hygienist or registered dental mechanic holding interstate or infra-state valid registration is authorized and free to practice". As such all dental surgeons, dental hygienist or registered dental mechanic applying for a post or a position while holing inter-state or intrastate valid registration with any State Dental Council of the country is eligible for his/her candidature for appointment to a post/position by any of the organisation functioning under your State Govt. With the above and as per decision of the General Body of the DCI in its meeting held on 23rd & 24th January, 2019, I am directed to request you to kindly follow the provisions prescribed u/s 46(5) of the Dentists Act, 1948 and consider the inter-state or intra-state registration of the dental surgeons, dental hygienist or dental mechanic with any of the State Dental Council as per section 46(5) of the Dentists Act, 1948. However, your organization may after finally selecting the applicant ask to get his/her name transferred u/s 46A of the Dentists Act, 1948."
The Dental Council of India has been constituted by an Act of Parliament to regulate the profession of dentistry and also to maintain the highest standards of dental education in the country. It is the statutory and bounden duty of the DCI to take such steps which are required to be taken to maintain the highest standards of dental education in the country
Any dental qualification granted by any person/authority/institution is not valid unless and until it is according to the norms of the DCI Act and Regulations made thereunder, the respective provisions of Section 10, 10A and 10B of the Dentists Act, 1948.
