Justice for Medico Assault: 3 year jail sentence to patient relative who assaulted doctor on duty

Shimla: Providing justice to a government doctor who was assaulted by a patient’s relative, the Chamba court has now awarded three years of rigorous imprisonment and a fine of Rs 10,000 to the attacker.

The incident goes back to September 4, 2018, when Dr Kamal Jeet was on night duty at Regional Hospital in Chamba. The accused man of Upper Julakhari, had brought his wife to the emergency ward and told the doctor that she was not feeling well. The doctor examined her and prescribed a few medicines. A few hours later the man again returned to the emergency ward and started misbehaving with the doctor. Meanwhile, when the doctor went to see other patients, the man followed him and started forcing him to attend his wife first.

The man then moved ahead and held the collar of the doctor and assaulted him. He even threatened to kill the doctor. Fortunately, a person present in the ward came forward to save him, reports the TOI.

The doctor then approached the local police to file a complaint against the man.

The matter was taken to sessions court where the further proceedings were carried out.

The court after going through the evidence awarded the following punishments to the attacker for his various offences:

• For offence of assault or criminal force to deter public servant from discharge of his duty- 3 years imprisonment along with Rs 10,000 fine.


• For offence of voluntarily causing hurt to deter public servant from his duty- 1 year of rigorous imprisonment along with Rs 5,000 fine.


• For the offence intentional insult with intent to provoke breach of the peace- 2 years of imprisonment along with Rs 8,000 fine.


• For the offence of punishment for criminal intimidation- Six month rigorous imprisonments along with Rs 5,000 fine.


• If threat be to cause death or grievous hurt, etc- Six month rigorous imprisonment along with Rs 5,000 fine.

All these sentences would run simultaneously, the judgment noted.
