Dissatisfaction with EXPECTED standard of care not grounds for medical negligence: Delhi HC grants relief to Max Hospital

While dismissing the medical negligence claims against Max Super Speciality hospital doctors, the Delhi High Court recently observed that mere dissatisfaction or the assertion of an "expected" standard of care does not establish medical negligence.

Relying on the landmark judgment in the case of Bolam V. Friern Hospital Management Committee, the Court opined that the yardstick of medical negligence is whether the doctor's conduct and opinion fell below that of a reasonably competent practitioner in similar circumstances.

Medical college head denied bail in Rs 65 crore admission scam involving 350 aspirants

Noting that the delay in starting the trial was due to the applicant's inaction in progressing the case, rather than any fault on the prosecution's part, a special PMLA court in Mumbai rejected the bail of Mahadev Deshmukh, former working president of the Kolhapur-based Shri Chhatrapati Shivaji Education Society (SCSES), who allegedly collected over Rs 65 crore from 350 medical aspirants for admission in a college run by the trust.

This marks the second time the applicant has sought bail, citing delays in the trial and arguing that there is no reason for him to remain in jail. Medical Dialogues in August this year reported that a special PMLA court in Mumbai rejected his first bail application due to his primary involvement in the crime.

UP doctor arrested for burning man alive to fake his own death and claim insurance money

In a horrifying incident, a Baghpat-based doctor, who was facing a huge Rs 30 lakh debt that he could not repay, is alleged to have burned a man alive to fake his own death and claim insurance money to settle his debts.

What is more disturbing is that the doctor allegedly planned the whole thing, calculated every step and he was allegedly inspired by a popular crime television series, CID. After inviting the deceased for a couple of drinks, the accused doctor put the deceased inside the doctor's own car to make it look like that the doctor himself had been murdered.
