Allahabad HC Rejects Plea Seeking 1 Percent Senior Citizens’ Reservation in Medical Admissions
The Allahabad High Court has rejected a plea seeking 1% reservation or a special quota for eligible senior citizens seeking admission to MBBS and other medical courses through NEET. A Division Bench comprising Justice Rajan Roy and Justice Manjive Shukla upheld a Single Judge's order dismissing the petition, observing that introducing such reservation falls within the jurisdiction of the competent legislature or government. The Court noted that no existing provision grants senior citizens such reservation benefits and that the petitioner had no enforceable legal right to demand the proposed quota.
The petitioner had sought directions to authorities to consider his representation dated June 23, 2026, and take a policy decision on senior citizen reservation in medical admissions. However, the Bench held that a writ of mandamus could not be issued merely to compel consideration of a non- statutory representation. Finding no error in the earlier judgment, the Court dismissed the appeal, leaving the matter for government consideration, according to a Live Law report.
