While considering the plea filed by a NEET UG candidate in this regard, the HC Single Judge bench of Patna High Court, comprising Justice Harish Kumar, dismissed the plea.
"In view of the submissions advanced by the learned Advocate for the respondents NTA as well as NMC, besides the specific contention denying any mismanagement and defiance of any terms and conditions in holding the examination, this Court does not find any reason or occasion to continue with the present writ petition...Accordingly, the writ petition stands closed, sans any merit," the HC bench observed.
The grievance of the petitioner was limited to the extent that in the Centre in question, where he had appeared as a candidate of the NEET UG 2025 examination held on 04.05.2025, on account of mismanagement and delay in the distribution of question papers and answer sheets to the appearing candidates.
It was alleged that the petitioner, along with others, had not been allowed to utilize the complete three hours, and almost 30-35 minutes of the examination stood wasted, causing serious prejudice and suffering. Based on these grounds, the petitioner prayed for a re-test of the NEET UG Examination in the said Centre.
NTA, in its counter-affidavit, submitted that the Principal of the Utkramit Uchch Madhyamik Vidyalaya, Kurthaul, Centre No. 1502107, Centre Name Bapu Pariksha Parisar, Kumhrar, Patna, who was the Centre Superintendent, along with the Invigilator of the afore-noted Centre, have categorically stated in their respective response that no candidate, including the petitioner, raised any complaint regarding the conduct of the examination or shortfall of time. The examination was duly commenced at 2:00 pm sharp and continued without interruption till 5:00 pm and all the candidates have been extended a complete three hours' time. It has further been disclosed that after completion of the examination, all the OMR answer sheets were duly collected from the candidates and placed in the pink envelope, sealed in the presence of two candidates from the room, who also acted as witnesses and put their signature. The counter affidavit categorically stated that regarding strict compliance with the NTA’s prescribed procedure and no mismanagement has been found in the Centre in question.
The Court noted that even though the counter affidavit was filed on 23.09.2025, no denial of the averments. Considering the submissions advanced by the counsel for NTA as well as NMC, besides the specific contention denying any mismanagement and defiance of any terms and conditions in holding the examination, the HC bench denied to entertain the plea.
