Reservation to OBC candidates in State surrendered MDS seats under AIQ from 2021-22 will be based on SC verdict: NBE
New Delhi: Through a recent notice, the National Board of Examinations (NBE) has informed that reservation to OBC candidates in State surrendered MDS seats under All India Quota from the academic session 2021-22 will be subject to the outcome of the case pending before the Hon'ble Supreme Court.
The information for all the concerned NEET MDS candidates and various stakeholders comes pursuant to the directions from the Ministry of Health and Family Welfare, Govt. of India.
The National Board of Examinations issued the Information Bulletin for NEET (MDS) –2021 on 26th October, 2020. Under Clause 10.11, it is mentioned that the OBC reservation at 27% shall be applicable only in Central Government Institutions/Central Universities (for Non-creamy layer and as per Central list of OBC).
The Hon'ble High Court of Madras vide Order dated 27.07.2020 in WP No. 8324 of 2020 directed that a committee comprising the representatives of Directorate General of Health Services, Government of Tamil Nadu, Medical Council of India and Dental Council of India be constituted for providing the terms of implementation of reservation in AIQ for next academic session.
The Committee constituted in pursuance of the directions of the Hon'ble High Court of Madras has submitted its report to the Central Government. After considering the report, the Central Government has decided to place the same before the Hon'ble Supreme Court (wherein a Writ Petition No. 596/2015 titled Saloni Kumari & Anr. Vs. DGHS regarding 27% reservation in favour of candidates belonging to OBCs in All India Quota Seats is pending) for decision.
Therefore, it is brought to the notice of all concerned that reservation to OBC candidates in State surrendered seats under All India Quota from the academic session 2021-22 will be subject to outcome of the case pending before the Hon'ble Supreme Court in Writ Petition No. 596 of 2015 / any decision taken by the Central Government in this regard.

NEET-MDS is an eligibility-cum-ranking examination prescribed as the single entrance examination for admission to various MDS Courses under Dentists Act, 1948 (amended from time to time). No other entrance examination, either at state or institution level, shall be valid for entry to MDS Courses.
The responsibility of NBE is limited to the conduct of NEET MDS, declaration of the result and handling of the result to MCC, DGHS, MoHFW for onward transmission to State Counseling Authorities. NBE has no role in counseling and allotment of seats. Documents verification and eligibility determination shall be undertaken at the time of counseling/admission process.
The National Board of Examinations was established in 1975 with the prime objective of improving the quality of the Medical Education by elevating the level and establishing standards of post graduate examinations in modern medicine on an all India basis. There are more than 149 recognized Medical Colleges in the country. In addition to Postgraduate teaching institutions under MCI, there are 450 accredited institutions imparting training in various Broad and Super specialities for the award of postgraduate qualification in Broad and super specialities. The Board at present conducts postgraduate and postdoctoral examinations in 54 disciplines approved by the Board for the award of Diplomate of National Board. The Medical Council of India has laid down standards for post graduate examinations conducted by various medical colleges and affiliated to concerned universities and other institutions, yet the levels of proficiency and standards of evaluation vary considerably in these institutions. The setting up of a National Body to conduct post graduate medical examination was intended to provide a common standard and mechanism of evaluation of minimum level of attainment of the objective for which post graduate courses were started in medical institutions. Moreover, intra country and international comparison is facilitated with the availability of commonly accepted evaluation mechanism.
