SC relief to PG medical aspirant: Allows to appear in NEET PG Counselling without original documents
New Delhi: While considering the plea of a Postgraduate medical aspirant who is facing troubles to appear in the National Eligibility-cum-Entrance Test Postgraduate (NEET-PG) counselling, the Supreme Court issued notice to the Medical Counselling Committee (MCC).
The student wished to give up her seat at Kasturba Medical College, Manipal and appear in NEET PG Counselling 2022-2023. However, in order to release the original documents, the college authorities are demanding the payment of balance tuition fees for the remaining two years, in terms of the Bond submitted by the student at the time of admission.
Issuing notice in the matter, the Supreme Court bench comprising of Justices Ajay Rastogi and C.T. Ravikumar has also directed the MCC to allow the student to appear in the counselling process and join the course without hindrance.
"Issue notice, returnable on 25.11.2022. In the meanwhile, the respondents are permitted to allow the petitioner to participate in the counseling scheduled to be held from 26.10.2022 to 30.10.2022 in terms of the Notification dated 19.10.2022 and if she is able to crack in the counseling process, she may be permitted to join without insisting upon her to furnish the original documents," read the order.

The petitioner student appeared in NEET-PG examination 2021-2022. Consequently she joined post-graduate course in MS (Oto-RhinoLaryngology) or MS (ENT) of three years duration at Kasturba Medical College, Manipal on 24.02.2022 as a Junior Resident. However, she wanted to join postgraduate course in other discipline of her choice and therefore, she appeared in NEET PG examination 2022-2023.
After qualifying the exam, she wishes to appear in the second counselling to be held from 26.10.2022 to 30.10.2022. However, in order to secure admission, the student will be required to submit original documents which she has surrendered to Kasturba Medical College, Manipal.
Meanwhile, the college has asked the student to furnish the balance tuition fee of two remaining tears in terms of Bond furnished. Being unable to comply with these terms, the student approached the Apex Court seeking relief.
Taking note of the submissions of the petitioner student, the court has issued notice in the matter. Meanwhile, the court directed the Medical Counselling Committee (MCC) to allow her to appearing in the NEET PG counselling. Further, in case the student cracks the counselling, the court has directed her to join the course without insisting upon her to furnish the original documents.
