Autonomous Institutes are separate, no spousal transfer allowed between them: MoS Health

New Delhi: Doctors, nurses and faculty working in premier government health institutions under the Ministry of Health and Family Welfare, such as the All India Institute of Medical Sciences (AIIMS), Postgraduate Institute of Medical Education and Research (PGIMER) Chandigarh, and Jawaharlal Institute of Postgraduate Medical Education and Research (JIPMER) cannot seek inter-institutional transfers on spouse grounds, as there is currently no provision allowing transfers between autonomous bodies.
The information was provided during a recent Lok Sabha session in response to an unstarred question raised by MP Dharamvira Gandhi. The MP sought details regarding:
(a) the total number of representations received during the last five years from Employee Associations, Unions, MPs and Ministers seeking a uniform spousal transfer/posting policy in various autonomous bodies under the Ministry such as AIIMS, PGIMER, JIPMER, NIMHANS, RIMS, NEIGRIHMS etc.;
(b whether some of these institutions have rejected such requests citing absence of specific provision in their Acts/Rules/Bye-laws, despite implementing common recruitment rules not mentioned in the Acts, if so, the details thereof;
(c) whether the Acts/Rules of these bodies provide that Government of India rules/guidelines shall apply in matters not covered by them and if so, the reasons for not applying DoPT’s spousal posting guidelines (O.M. dated 30.09.2009 & subsequent clarifications);
(d) if so, the details thereof, including the action taken by the Government;
(e) whether DoPT was consulted in this regard, if so, the details of the outcome and if not, the reasons therefor; and
(f) whether uniform guidelines in this regard are likely to be proposed, if so, the details thereof?
While answering the questions, the Minister of State for Health and Family Welfare, Prataprao Jadhav, stated that representations regarding transfers on spouse grounds between autonomous institutes have indeed been received. However, he clarified that all these autonomous institutes are separate entities and there is no provision to transfer employees from one autonomous institute to another.
He added, "All Autonomous Institutes are separate entities, and there is no provision to transfer employees from one Autonomous Institute to another."
