Delhi HC directs MCD to not withhold salaries of paramedical staff at RBIPMT, MVID Hospital

The counsel for the petitioner argued that the MCD order was passed without considering that many members of the petitioner/Union are not educated and do not own smartphones and, therefore, it is not possible for them to mark their attendance through the MCD SMART App.

New Delhi: In a recent order, the Delhi High Court directed the Municipal Corporation of Delhi not to withhold the salaries of the employees of its paramedical technical staff welfare association just on account of them being unable to mark their attendance in the MCD SMART App through a smartphone. 

The single judge bench of Justice Rekha Palli passed the order after a petition was filed by the paramedical technical staff welfare association challenging the order passed by the Municipal Corporation of Delhi (MCD), which had ordered that the salaries of all para-medical staff of the RBIPMT and MVID hospitals would only be released after they mark their attendance through the MCD SMART App via smartphones.

The counsel for the petitioner argued that the MCD order was passed without considering that many members of the petitioner/Union are not educated and do not own smartphones, and, therefore, it is not possible for them to mark their attendance through the MCD SMART App. 

The MCD did not appear despite advance service, due to which the court could not seek an explanation from them on why the attendance of the staff could not be marked by any other mode till the petitioners are able to purchase smartphones and are provided the necessary training to operate the MCD SMART App. 

The court observed, "Till the next date, respondent no.2 will ensure that the salaries of the employees of the petitioner/union are not withheld on account of their not being able to mark their attendance in the MCD SMART App through a smartphone." 

While scheduling the matter to be heard next on 28th October this year, the court issued notices to the respondents and asked counter affidavit to be filed within four weeks.
