Ghaziabad POCSO court orders FIR against doctor in alleged molestation case
Ghaziabad: In a significant order, a special POCSO court in Ghaziabad has directed police to register an FIR against a doctor accused of sexually abusing a teenage girl who was working as a caregiver for his child.
The order was issued on Thursday by Special POCSO Judge Neeraj Gautam, following an application filed by the girl's father under Section 173(4) of the Bharatiya Nagarik Suraksha Sanhita (BNSS).
The father had approached the court alleging that the Station House Officer (SHO) of Wave City police station and senior police officials failed to act on his repeated complaints.

According to TOI, “The doctor engaged in obscene acts with my daughter when they were alone. He would touch her inappropriately, strip her naked and force her to sit on his lap,” the father wrote in his application. “When my daughter refused, he threatened to kill her. For a long time, she remained frightened.” He claimed his daughter was distraught. He took her to their native village in Bihar in the hope that it would help her de-stress. But things did not improve. He would find her crying all the time there as well. The doctor called a few times, but the girl refused to return to work.
After the family returned to Ghaziabad on March 1, the doctor allegedly visited their home the next day and again insisted that the teenager resume work. When she refused, he allegedly lodged a false theft complaint against her.
The father alleged that the girl was subsequently called to Lal Kuan police station, where she was assaulted by police personnel. He also claimed that when he and his son reached the police station, officers assaulted his son. It was only after returning home that the teenager disclosed the alleged sexual abuse to her family.
Following the disclosure, the father submitted complaints to the Ghaziabad Police Commissioner. Although the family was later called to the office of the Assistant Commissioner of Police and their statements were recorded, no FIR was registered.
Instead, the father alleged that police officials repeatedly pressured him to settle the matter with the doctor. “I was summoned to the Wave City police station where the doctor was already present. The police officers asked us to compromise, but when I refused,” the father told the court.
He subsequently submitted complaints to the Ghaziabad Police Commissioner, the Director General of Police in Lucknow and the Chief Minister on April 17, but alleged that no action was taken.
The special court judge, Neeraj Gautam, said, “Considering the facts and circumstances of the case, the doctor is entitled to a cognisable offence. It appears justified to have the police investigate.” He ordered the station house officer of Wave City police station to register a case under the relevant sections based on the statements made in the application. “Ensure that the investigation is conducted and a report submitted to the court,” the judge said, reports TOI.
