J-K: Assistant Professor, Medicine dept at SMHS Hospital terminated over alleged ties with terror groups

Jammu: In a significant move, the Jammu and Kashmir administration on Wednesday terminated an Assistant Professor of the Medicine department of Shri Maharaja Hari Sing Hospital (SMHS) Srinagar, from services for his alleged terror links in the Union Territory.

The assistant professor, along with three other government employees, have been dismissed by the J&K government under Article 311 (2) (c) of the Constitution. The doctor dismissed is Nissar-ul-Hassan, the president of the Doctors Association of Kashmir (DAK).

An order issued by the Government of Jammu and Kashmir General Administration Department mentioned “Whereas the Lieutenant Governor is satisfied after considering the facts and circumstances of the case, and on the basis of the information available, that the activities of Dr Nisar-ul-Hassan, Assistant Professor (Medicine), SMHS Hospital Srinagar… are such as to warrant his dismissal from service."

The doctor has been dismissed under Article 311(2)(C) of the Constitution, which allows the government to terminate employees without ordering an inquiry into their conduct or giving them an opportunity to explain their position if the “President or the Governor, as the case may be, is satisfied that in the interest of the security of the State, it is not expedient to hold such inquiry”.

“And whereas the L-G is satisfied under sub-clause (C) of the proviso of clause (2) of Article 311 of the Constitution of India that in the interest of the security of the state, it is not expedient to hold an enquiry in the case of Dr Nisar-ul-Hassan," reads the order issued on November 21. 

As per an IANS report, the process of dismissal of government employees was started in J&K in 2022 when the UT government forced a committee that was empowered to investigate allegations of government employees' involvement in anti-national activities.

The committee was empowered to recommend the dismissal of such employees from government service. 

"The dismissal of these government employees follows their involvement with the forces that work against India by spreading malicious propaganda," officials said.

In the last three years, the Union Territory administration has invoked 311 (2)(c) of the Constitution to sack more than 50 employees, who were allegedly operating in shadows within the government and drawing a salary from the public exchequer, however, they were helping Pakistani terror outfits, providing logistics to terrorists, propagating terrorists’ ideology, raising terror finances and furthering secessionist agenda, officials said.
