Medical teachers cant be permanently transferred unless there is natural calamity or mass disease: Tripura HC

Agartala: Noting that unless there is any natural calamity or any catastrophe of mass disease, medical college teachers can not be transferred permanently, the Tripura High Court has recently cancelled the transfer orders of eight medical college teachers (doctors) and asked the state government to bring them back in their original place of posting by February, a lawyer said on Tuesday.

Senior lawyers Pijush Kanti Biswas and Purosattam Roy Barman defended the teachers in the high court after they filed petitions against the Tripura government's transfer orders dated August 3 last year.

It is reported that a single bench of Tripura High Court held in the favour of the medical teachers, prompting the government to file an appeal.The Tripura government filed four writ petitions before the division bench against the order of the single bench.

Now division bench of Tripura High Court comprising Chief Justice Akil Kureshi and Justice Arindam Lodh, while cancelling the transfer orders of eight teachers of the state government run Govind Ballabh Pant Medical College and Hospital on Monday, said that their transfers were in violation of Medical Service rules.

"The high court division bench while upholding the single bench judge Subhashish Talapatra's order said that unless any natural calamity or any catastrophe of mass disease, medical college teachers can not be transferred permanently," Roy Barman told IANS quoting the HC judgement.

The court cancelled the order making it clear that  Rule 21 of Tripura Medical Education Service, 2015 did not allow for meeting shortages of doctors in hospitals by posting teachers from other hospitals, quotes the TOI
