Shiv Sena Corporator moves bail plea in Dombivli hospital assault case

Thane: In connection with the alleged assault on two doctors and nurses at Kalyan-Dombivli Municipal Corporation (KDMC)-run Shastrinagar Hospital, the Shiv Sena corporator has sought bail, claiming that he had no personal grudge against the medical staff and was acting in his capacity as a public representative while assisting citizens.  

According to the news reports, the bail plea cited health concerns faced by the corporator, stating that he has only one kidney and suffers from high blood pressure. On Monday, the corporator and three associates, who were also arrested in the assault case, were sent to judicial custody.

The Thane city police produced the accused before the court through video conferencing, citing possible law and order concerns. 

“The corporator and his three associates were produced before the court and remanded in judicial custody. His lawyer has applied for bail,” a senior police officer said.

Speaking to The Indian Express, the corporator’s lawyer Sanjay Dhanke said that since there was no recovery to be made from the accused by the police, they did not seek his custody. The lawyer said that the hospital will carry out the corporator’s medical test and he will be sent to Aadharwadi prison in Kalyan if he is found to be fit.

According to Dhanke, the bail plea stated that the corporator had intervened as a public representative after a citizen approached him with a grievance and alleged that the hospital authorities were not providing assistance.   

Dhanke added that the corporator’s medical condition was also cited as a ground for bail. After the bail application was filed, the court sought a response from the investigating officer before passing further orders.

The case stems from an incident on July 6 following a dispute over the treatment of a newborn at the Dombivli civic hospital. Doctors had reportedly advised the family of a newborn to shift the infant to another hospital due to the unavailability of beds in the Neonatal Intensive Care Unit (NICU). 

Following the advice, the patient’s family allegedly contacted the corporator, after which he was accused of assaulting the doctor and hospital staff members. Police subsequently registered a case and arrested the corporator along with three others. 

Medical Dialogues had previously reported that following the alleged assault of two doctors by a Shiv Sena corporator at Kalyan-Dombivli Municipal Corporation (KDMC)-run Shastrinagar Hospital, the doctors involved have resigned, citing severe emotional trauma and concerns over workplace safety.

The incident has triggered criticism from opposition parties, with allegations of attacks on medical professionals drawing wider concern. The Central Maharashtra Association of Resident Doctors also observed a statewide black ribbon protest across government and semi-government medical colleges and hospitals in response to the incident.
