Khyati Hospital PMJAY Fraud: 15 patients move Gujarat HC for Separate FIR Registration

Ahmedabad: After being subjected to unnecessary angioplasty procedures without any related symptoms and prior consultation with their families, the 15 patients who survived the procedures at Khyati Hospital in Bodakdev have moved to the Gujarat High Court seeking justice and appropriate action in the matter. 

In their petition, the patients sought registration of a separate FIR on the physical problems that they continue to face after the surgery, a fair in-depth- investigation and proper compensation for the physical trauma that they had to experience.

The patients claim they were subjected to unnecessary angioplasty as part of the hospital’s alleged misuse of the Ayushman Bharat health scheme. Therefore, they alleged that they too are victims of the scam. 

Medical Dialogues reported in November 2024, that two patients, who attended a free medical camp organized by Khyati Hospital under the Ayushman Bharat Pradhan Mantri Jan Arogya Yojana (PM-JAY) passed away due to postoperative complications following Angioplasty procedures.

This incident caused widespread outrage as an angioplasty was performed at the hospital on 19 patients and two of them died while 5 others were kept on ventilation. These 19 people were brought to Khyati Hospital by ambulance for treatment after they attended the free health checkup camp in Borisna village of Kadi taluka on November 10. Around 80 to 90 people were examined at the camp. 

Following this, three FIRs were filed, two at the behest of the kin of the deceased and one by a doctor from the Government-appointed panel.

Speaking to TOI, Advocate Siddharth Desai informed, "The patients said they have been facing difficulties after the procedure and an investigation is required. Three FIRs were registered at the behest of a whistleblower. However, that should not curtail the victim's right to demand the registration of an FIR for his/her complaint."

The petition is expected to be heard by the HC on Thursday. 

Meanwhile, another petition has been filed before the court by Khyati Hospital's director Kartik Patel. Patel is currently at large and was reported to be hiding abroad supposedly in Dubai at present since the alleged PM-JAY scam came to light.

In his petition, Patel sought direction from the court to direct the police to club the three FIRs registered in the case. The petition contends that the three FIRs were registered on the same facts and that three separate probes and prosecutions would not serve any purpose.
