The National Consumer Disputes Redressal Commission (NCDRC) recently exonerated Fortis Hospital, Mohali, from allegations of medical negligence while conducting total knee replacement surgery on a patient.

Even though the State Consumer Court, Punjab, had directed the hospital to pay Rs 15 lakh as compensation to the patient, the Apex consumer court noted that the complainant failed to provide any cogent evidence regarding the allegations of medical negligence.

"Relying on the principles laid down by the Hon’ble Supreme Court in the judgments quoted above, we are of the view that the complainant has failed to provide any cogent evidence as regards negligence of the hospital or the anaesthetist or the Orthopadic Surgeon in the course of the surgery or in the post operative care. Even the allegation that she was 100% paraplegic is not borne out from the record," noted the Commission.

In this regard, the NCDRC bench took note of the Supreme Court order in the case of PGIMER Chandigarh vs. Jaspal Singh, where it was held that in medical negligence actions, the burden was on the claimant to prove breach of duties, injury and causation.

NMC issues show-cause notice to 26 Telangana GMCs

For deficiencies in academic and administrative infrastructure, the National Medical Commission (NMC) recently issued show-cause notices to 26 government medical colleges in Telangana.

In the show-cause notice, NMC highlighted deficiencies in infrastructure, clinical material, and teaching personnel. The Apex Medical Commission took note of these deficiencies during its routine annual assessment of medical institutes across the country.

There are altogether 34 government medical colleges in Telangana. Out of these, 26 medical colleges have received an NMC Show Cause. The only exceptions are Gandhi Medical College, Osmania Medical College, Rajiv Gandhi Institute of Medical Sciences (RIMS), Adilabad, Government Medical College Nizamabad, Government Medical College Maheshwaram, Government Medical College Yadadri, and Government Medical College Vikarabad.

However, the Director of Medical Education (DME), Telangana, has assured that the show-cause notice is a routine exercise by the Commission to ensure the presence of proper infrastructure at the medical colleges across the State.

Resident doctor dies after suicide attempt, accuses HoD Pharmacology of harassment

In an unfortunate incident, a resident doctor at SN Medical College, Jodhpur, who allegedly committed suicide after consuming a sulphos tablet on Friday, sadly passed away during treatment at SMS Hospital on Saturday night.

After his death, the family members of the deceased, a 3rd-year postgraduate student in Pharmacology, refused to accept his body on Sunday, alleging that he was subjected to mental harassment by the Head of the Pharmacology Department. It has been reported that the professor’s alleged constant pressure and toxic behaviour over his thesis caused him severe stress and emotional distress.

Demanding an action and investigation against the professor, the family staged a sit-in protest outside the hospital, and the resident doctors of Jodhpur's SN Medical College and Jaipur's SMS Medical College also joined them in solidarity at SMS hospital's mortuary, where the body of the deceased was kept.

UP doctor arrested for alleged negligence in death of woman and newborn

In an alleged case of medical negligence, a 25-year-old woman and her newborn baby died during treatment at Vibhrant Hospital in Khadda town of Uttar Pradesh. The doctor has been arrested on charges of medical negligence, and the private hospital has been sealed, an official said.

A doctor was arrested on Saturday in the Khadda area of this district over the death of a 25-year-old woman and her newborn child, police said.

The accused, Dr Mohammad Sayed, has been arrested on charges of medical negligence and the private hospital where he was working sealed, officials said.

"A 25-year-old woman, Asma Khatoon, wife of Sikandar, and her newborn baby died during treatment at Vibhrant Hospital located at Maharana Pratap Chowk on Khadda-Nebua road in Khadda town," Sub-Divisional Magistrate (Khadda) Mohammad Zafar said, news agency PTI reported.

The incident took place on Friday night when a 25-year-old woman was admitted to the hospital after experiencing labour pain.
