Doctor held guilty of sedating, raping 15 year old; sentenced to 10 year jail by POCSO court

When the patient didn't reach home soon, her family members started looking for her. Later, they found her unconscious in the clinic.
Bijnor: A city based doctor, recently held guilty by a Protection of Children from Sexual Offences (POCSO) court for allegedly sedating a minor patient and raping her at his clinic three years ago; has been slapped with a 10 years jail term along with Rs 50,000 fine.
According to a recent TOI report, the incident took place in the year 2015 when the 15 year old patient who was suffering from high fever at that time went to the doctor's clinic for treatment.
When the patient didn't reach home soon, her family members started looking for her. Later, they found her unconscious in the clinic. After gaining senses, the girl accused the doctor of rape and said that he had allegedly sedated her with an injection, and raped her afterwards, reports TOI.
Thereafter, the mother of the patient filed a case against the accused doctor in Nahtaur police station.
The case led on for 3 years and now holding the doctor guilty the POCSO court sentenced him for 10 years jail.
Informing about the court's action, Vinish Kumar, assistant prosecution officer told TOI, "The court heard the arguments of both the sides, and held the doctor guilty of raping the minor. It awarded imprisonment of 10 years to him, with a fine of Rs 50,000. Out of this fine, Rs 40,000 is to be given to the victim."
Medical Council of India (MCI) had earlier posted the guidelines for Doctors on Sexual Boundaries on its official website reminding the doctors to know about their boundaries of being intimate with a patient, both physically and mentally. Non-consensual sexual activity is a crime but doctors agree that even consensual sexual activity in a power imbalanced relationship like that of a doctor and patient is not truly consensual.
