New Delhi: The Undergraduate Medical Education Board (UGMEB) of the National Medical Commission (NMC) has now stopped the migration of MBBS students from one medical institute to another.

In the Graduate Medical Education Regulations, 2023, which was published in the official Gazette on June 02, 2023, NMC UG Board addressed the issue of student migration and mentioned, "No student designated to a Medical Institution, notwithstanding anything stating in these regulations, shall seek migration to any other Medical Institution."

The final regulations published in The Gazette of India are a massive modification from what was mentioned in the draft version of the GMER, 2023 that was introduced in the public domain on February 27, 2023.

Medical Dialogues had earlier reported that in the Draft version of the Regulations, NMC had specified that migration shall be granted only from a government medical college to a government institute and from a non-government (private) medical college to a non-government institute.

Referring to the issue of Migration, NMC specified, "No student designated to a medical institution, notwithstanding anything stated in these Regulations, shall seek migration to any other medical institution after the first academic year of admission."

While the draft was silent regarding the number of seats for which migration is allowed, it had mentioned that, "Migration of students from one medical college to another medical college shall be granted as per the guidelines of UGMEB of NMC, only in exceptional cases to the most deserving among the applicants for good and sufficient reasons and not on routine grounds. Migration shall be from a government medical college to a government medical college and from a non-government medical college to a non-government medical college only. No mutual exchange shall be permitted."

However, in the final version of the regulations that have been published in the official Gazette NMC has stopped the practice of student migration completely and mentioned, "No student designated to a Medical Institution, notwithstanding anything stating in these regulations, shall seek migration to any other Medical Institution."

This is in contradiction to the earlier rules which did not restrict migration of students from government to private institutes and vice versa. In fact, previously the candidates used to be eligible for migration only after qualifying the first professional MBBS examination.

Apart from this, the previous rules of the erstwhile Medical Council of India (MCI) had also restricted migration to 5% of the sanctioned intake of the college during the year. Previously, migration was not allowed on any ground from one medical college to another located within the same city.

According to 2008 amendments to the MCI Regulations on Graduate Medical Education, 1997, "Migration of students from one medical college to another medical college may be granted on any genuine ground subject to the availability of vacancy in the college where migration is sought and fulfilling the other requirements laid down in the Regulations. Migration would be restricted to 5% of the sanctioned intake of the college during the year. No migration will be permitted on any ground from one medical college to another located within the same city."

"Migration of students from one College to another is permissible only if both the colleges are recognized by the Central Government under section 11(2) of the Indian Medical Council Act, 1956 and further subject to the condition that it shall not result in increase in the sanctioned intake capacity for the academic year concerned in respect of the receiving medical college," the previous regulations further mentioned.

While the NMC has now stopped the migration of students altogether, according to the former rules, "The applicant candidate shall be eligible to apply for migration only after qualifying in the first professional MBBS examination. Migration during clinical course of study shall not be allowed on any ground."

Migration would be restricted to 5% of the sanctioned intake of the college during the year.

· No migration will be permitted on any ground from one medical college to another located within the same city.

· Migration of students from one College to another is permissible only if both the colleges are recognised by the Central Government under section 11(2) of the Indian Medical Council Act, 1956 and further subject to the condition that it shall not result in increase in the sanctioned intake capacity for the academic year concerned in respect of the receiving medical college.
