NMC setting up panel of Experts to support Ethics Board, invites nominations from Medical Colleges, details

New Delhi: The National Medical Commission is going to create a panel of experts to offer comments on the appeals made against the decision of the State Medical Councils. For the same, the NMC has sought details of eligible professors, additional professors and associate professors.

Experts from different fields of specialties including Cardiology, Obs & Gynae, Oncology, Urology etc having 6 years or more of teaching experience will be part of this panel, the Ethics and Medical Registration Board of NMC has recently informed.

Writing to the Deans and Principals of the Government medical colleges in the country, the NMC board has recently informed, "Ethics and Medical Registration Board of the National Medical commission is in the process of creating a panel of experts related to different fields of specialties viz Cardiology, Obs & Gynae, Onclogy, Urology etc. to offer comments/ opinion in the appeals made to EMRB against the decision of the State Medical Councils. In this regard, it has been decided to seek details of eligible and willing teachers having 6 years or more of teaching experience on regular post."

"Experts are supposed to study the appeal related documents and offer their comments on it within a prescribed time limit. A suitable fee as approved by NMC would also be given to them for providing opinion/comments in each case," added the letter.

"While forwarding the names it is to be ensured that the person should have integrity and uprightness and no vigilance case is pending or being contemplated against her/him," it further mentioned.

"You are requested to provide the information in their respect in the prescribed proforma which is enclosed herewith. The information can also be sent at ethics@nmc.org.in," read the letter issued by Dr. Yogender Malik, member of EMRB.

As per the proforma, the heads of the GMCs will have to submit the names of faculties who would be interested to join the NMC panel along with their date of birth, present designation, area of specialization, special interest within specialization and contact details including the Email and the Phone Number.

Apart from this, the proforma should also mention the present and permanent address of the faculties, contact details, educational qualifications including the subject studies as MD/MS, DM/MCh and PhD subjects.

Further, the proforma should also declare in detail about the teaching experience of the faculties. It should mention the designation, department, institution and the tenure of service of the faculties. Among other details, the PAN, AADHAR card details and the details of number of research articles, books and chapters published by the doctors should also be mentined in the proforma.

Finally, at the end of the proforma, the medical college chief will have to give an endorsement declaring that "This endorsement is the certification that lhe undersigned has satisfied herself/himself about the correctness, authenticity and veracity of the content of this declaration form in its entirety and endorsed the above declaration as true and correct. I have personally, verified all the certificates/documents submitted by the teaching faculty with the original certificates and documents that were submitted by her/him to the lnstitute and confirmed the same with the concerned lnstitute and have found them to be correct and authentic."

It should be mentioned in the context that only a medical practitioner can now appeal before NMC against any action taken by the State Medical Councils. Although earlier patients or any other person had the right to approach the apex medical regulator NMC with complaints against a doctor, now only medical professionals can approach the Commission.

This is because of Section 30(3) of the NMC Act 2019 that reads, "(3) A medical practitioner or professional who is aggrieved by any action taken by a State Medical Council under sub-section (2) may prefer an appeal to the Ethics and Medical Registration Board against such action, and the decision, if any, of the Ethics and Medical Registration Board thereupon shall be binding on the State Medical Council, unless a second appeal is preferred under sub-section (4)."
