50:50 MBBS, PG medical seats sharing formula for CMC Vellore, state is just and fair: SC

New Delhi: Disposing of the petition filed by the Christian Medical College (CMC), Vellore, the Supreme Court bench recently approved the 50-50 seat-sharing formula for the MBBS and PG medical seats between the medical institute and the State of Tamil Nadu.

Opining the arrangements to be appropriate, the top court bench comprising of Justices B.R. Gavai and Pamidighantam Sri Narasimha observed on August 10, "Taking into consideration the peculiar facts and circumstances of the present case, we find that the arrangement arrived at between the parties to the present petition is just and fair."

Medical Dialogues had earlier reported that in the original plea, the institute had sought directions from the Apex Court to quash the Selection Committee's letter where the Tamil Nadu Government sought to impose the state government's policy of 50 per cent reservation of seats i.e. the state quota seats in its favour in the UG and PG degree courses.

During the previous hearing of the case on January 19, 2022, the top court had directed, "After examining the submissions made on both sides, we are of the considered view that for the Academic Year 2021-2022, students belonging to Christian minority shall be allotted to all PG seats in the petitioner-college by the 2nd Respondent from the NEET merit list."

Back in February 2022, the top court had issued an interim direction in the case with respect to 2021-2022 PG admissions. At that time, the bench had clarified that the admissions to 70 per cent of the seats in the postgraduate courses at Christian Medical College, Vellore (CMC Vellore) would be from the list of Christian minority students prepared by the Tamil Nadu Government on the basis of the marks obtained by the students in the NEET PG examination.

The court had ordered that the remaining 30 per cent of the seats shall be filled up by the management by the same procedure that was followed in the last academic session i.e. 2020-2021. However, it had been clarified by the court that this order would be applicable only for the academic year 2021-2022.

Finally recording the terms of the agreement between CMC Vellore and the State, the top court bench dismissed the plea. The terms of the seat sharing arrangement are as follows:

"For the Undergraduate MBBS Course

a) 50% of the seats shall be filled up by the management by the same procedure that was being followed for earlier the academic years college on the basis of inter-se merit as per the NEET results.;

b) Out of this 50% of Management quota, as per past practice 10% seats to be allotted to the children of the staff members working in the applicant college on the basis of inter-se merit as per the NEET results.
c) Remaining 50% of the seats will be filled by the State Government from the state merit list of NEET examination in following manner:
(i) 30% of the seats will be filled by the State Government following its policy of reservation strictly in accordance with the NEET merit list; and
(ii) 20% of the seats shall be filled by the State Government candidates belonging to the Christian minority from the State strictly in accordance with the NEET merit list.
For the Post graduate courses
a) 50% of the seats shall be filled up by the management by the same procedure that was being followed for earlier the academic years college on the basis of inter-se merit as per the NEET results;
b) 50% of the seats will be filled by the state government out of which
(i) 30% of the seats will be filled by the State Government following its policy of reservation strictly in accordance with the NEET merit list; and
(ii) 20% of the seats shall be filled by the State Government candidates belonging to the Christian minority from the State strictly in accordance with the NEET merit list. CMC graduates who serve and fulfill the bond obligation outside Tamil Nadu as part of CMC's graduation program will be eligible for admission under this 20% minority quota, upon certification by the Principal of the Institution and them being within the merit for Christian minority."
