Bombay HC relief to two NEET 2022 candidates, slams state for delay in issuing certificates
Mumbai: Providing relief to two NEET candidates who could not apply for the NEET 2022 exam due to unavailability of 'Orphan Certificate', the Bombay High Court bench recently directed the Maharashtra Government to immediately certificates to them.
The bench comprising of Justices Revati Mohite Dere and Madhav Jamdar slammed the Government as it took note of the fact that even though the candidates had applied for the certificates to the Mumbai District Women and Child Development Office back in 2020, they were not issued the certificates.
Therefore while directing the authorities to issue and grant the orphan certificates to the students within a period of one week, the bench was quoted saying by PTI, "It is also significant to note that from November 2020 till date, the authorities have failed to inform about the nature of deficiencies in the applications."
Such observations came from the bench while it was considering an application filed by 'The Nest India Foundation' NGO, which runs the children's home, where the NEET candidates reside.

The application stated that two residents of the home had applied to the Mumbai District Women and Child Development Office for issuance of the 'orphan certificate' in November 2020. The duo required the certificate to apply for the National Eligibility cum Entrance Test (NEET)-2022 and admission in the MBBS degree course.
Appearing on the behalf of the petitioner NGO, advocate Abhinav Chandrachud argued that despite several trips to the office concerned and phone calls, the certificate was not issued.
On the other hand, Government pleader Purnima Kantharia told the court that there were certain deficiencies and shortcomings in the applications and hence, the certificate had not been issued.
Taking note of the submissions, the bench noted that the application for issuance of the orphan certificate was submitted in November 2020 and till date, no action has been taken by the authority concerned.
"It is also significant to note that from November 2020 till date, the authorities have failed to inform about the nature of deficiencies in the applications," noted the court.
As per the latest media report by the Times of India, the HC bench also noted that the last date for applying in NEET was extended for a short period. Therefore, it directed the authorities to issue the certificates immediately and noted, "As the cases of the students are already recommended by the CWC after examining the record, we do not see any impediment in granting this interim application."
