Disabled MBBS aspirant denied admission in MP Medical College, HC seeks response from NMC, Medical Education Dept

According to a recent report by Free Press Journal, a medical aspirant who cleared the competitive exam and secured an MBBS seat at a college, was refused admission, owing to her physical deformity. The petitioner had cracked NEET. She was allotted a seat in Shahdol Medical College.

Aggrieved with the admission denial, the aspirant filed a petition at the High Court.

She pointed out that the guidelines of the erstwhile Medical Council of India (MCI, now National Medical Commission (NMC) restrict admission to a candidate in MBBS Course if the candidate has over 80 per cent physical disabilities. She has also declared in her petition that she is only 65% disabled and hence, is eligible for admission into the undergraduate medical degree.

She invoked her rights under the Persons with Disabilities Act 2016 and expressed her sentiments of feeling violated on being denied admission.

The petitioner pointed out that by not permitting her admission into the MBBS course, the medical college is breaking the law.

The bench headed by Chief Justice Ravi Vijay Kumar Mathimal and Justice Vijay Kumar Shukla heard the petition and sought an answer from the Shahdol Medical College and the NMC with reference to the petition, reports The Free Press Journal.

NEET-UG is the qualifying exam for the candidates wishing to pursue their education in MBBS, BDS, BAMS, BSMS, BUMS and BHMS Courses. However, this year, NTA had mentioned that "Result of NEET (UG) - 2021 may be utilized by other Entities of Central/State Governments (including Indian Nursing Council/ Nursing Colleges/ Schools, JIPMER) for counselling/admission to relevant courses [including B.Sc. (Nursing) and B.Sc. (Life Sciences)] in accordance with their rules/norms/guidelines."

The results of this year's NEET 2021 were declared on November 1st.
