DMC Registrar Resigns After Govt Threatens Dissolution of Council
New Delhi: Within a few days of the Delhi Government threatening to dissolve the Delhi Medical Council (DMC) for violation of orders, the Registrar of DMC, Dr. Girish Tyagi resigned on Monday, TOI has reported.
Issuing a show-cause notice last week, the Delhi Government raised concerns about the operational irregularities of the Council, especially the extension of the registrar's tenure beyond the permitted age limit.
Clarifying that the continuation of Dr. Tyagi was not permitted, the Council directed him to relinquish from the charge of Registrar, DMC immediately. Medical Dialogues had earlier reported that, in the show cause notice dated 06.02.2025, the Council had mentioned, "Whereas the Deptt. of Health & Family Welfare, GNCTD vide letter No. 160/H&FW/2022/Council/1456 dt. 27.11.2024 has explicitly directed that enhancement of retirement age of Dr. Girish Tyagj. from 60 to 65 years is in complete violation of orders/communication issued time to time. And whereas, the WP (C) 16612/2024 titled Dr. Girish Tyagi Registrar Delhi Medical Council Vs. Govt. of NCT of Delhi and Anr. still pending in Honble High Court of Delhi and has not granted any stay on it. And whereas, the continuation of Dr. Girish Tyagi not permitted and directed to relinquish the charge of Registrar, DMC immediately."
"And whereas the post of Dy. Registrar is laying vacant, consequently, the DMC was directed to forward the panel of names for the appointment of Registrar in terms of provision made under section 14(3) and Dy. Registrar in terms of provision made under section 14(1) of the Delhi Medical Council Act, 1997 before 30.11.2024. And whereas, under section 14(4) the Council may with the previous sanction of the Government suspend or dismiss or remove any person appointed as Registrar or impose any other penalty upon him in the manner as may be prescribed," the notice added.
"And whereas Deptt. of H&FW, GNCTD shall take action against the Council after issuing a Show Cause Notice pinpointing the irregularities committed by them and if they don't take the remedial measures to remove the irregularities, the Council can be dissolved under Section 29 of the Medical Council Act, 1997. Now, therefore, you are hereby issued a show cause notice why the disciplinary action as deemed fit should not be initiated under Delhi Medical Council Act, 1997," the Council mentioned.
"The reply should be submitted to the undersigned within 07 days failing which it will be presumed that the officer/official is wilfully disobeying the direction and necessary action will be initiated against him/her without any further notice," warned the council.
As per the latest media report by the Times of India, the DMC President Dr. Arun Gupta informed that Dr. Tyagi had legally challenged the Government directive to vacate the position, and the matter is still pending before the Court. However, after the recent show cause notice, issued by the Government, Dr. Tyagi submitted his resignation. Dr. Gupta further added that the necessary documentation has been forwarded to the Government for processing.
