Every human life is precious: Patna HC orders tighter regulation of small hospitals

Patna: Bihar authorities have been directed to urgently tighten regulation of small healthcare facilities after the Patna High Court expressed concern over the large number of unregistered clinics and nursing homes operating across the state.

As per the news reports, a bench led by Justice Rajiv Rai observed that “every human life is precious” and made it clear that any irregularities in healthcare delivery would not be tolerated.

The observations came during the hearing of a case related to the sealing of an unlicensed paralysis and polio treatment centre in Vaishali district. According to officials, the facility was operating without proper registration and did not have qualified medical personnel.

The court was informed that authorities had imposed a fine of Rs 1 lakh and initiated legal proceedings against those responsible for running the illegal centre.

During the hearing, the bench also referred to a separate case in Bhojpur district, where an inquiry into a patient’s death revealed that as many as 81 nursing homes were operating illegally.

The bench expressed serious concern over the findings, highlighting the risks such unregulated establishments pose to public health and patient safety.

The state government informed the court that a policy to regulate hospitals with 1 to 40 beds is in its final stages. Officials said a committee led by Dr Rekha Jha submitted its report in February 2026, and the draft has cleared legal review and is currently under consideration by the finance department. A temporary exemption had earlier been granted to such hospitals under a notification issued in March 2025, reports Patna Press.

The High Court directed the health department to expedite the policy finalisation process and submit a progress report at the next hearing.

The bench underscored that effective regulation is essential to ensure accountability, improve standards of care, and safeguard patients across Bihar’s healthcare system.
