GMC Kozhikode 2017 Medical Negligence Case: Patient seeks Rs 1.9 crore compensation

Kozhikode: In an alleged case of medical negligence at Kozhikode Government Medical College Hospital (MCH) in 2017, K Harshina has filed a petition seeking compensation of Rs 1.9 crore for the suffering she was subjected to due to negligence. The petition, submitted at the Kozhikode sub-court, names eight individuals, including doctors and medical staff.
The case, which was considered by the court on Tuesday, has been postponed to March 18 for further hearings.
Medical Dialogues had earlier reported that after the submission of chargesheet at the Kunnamangalam court in an alleged medical negligence case at the Government Medical College Hospital (GMCH) in Kerala's Kozhikode, the police recorded the arrest of a doctor and two nurses and then let them off on bail.
Following her surgery in 2017, the woman endured continuous and severe stomach pain. Despite multiple visits to medical professionals, her condition remained unresolved. It wasn't until 2022 that an MRI scan revealed the shocking discovery. According to the Police reports forceps had allegedly been left inside a patient's body during her third C-section surgery at Kozhikode Medical College on November 30, 2017. The medical staff at Kozhikode Medical College reportedly failed to detect the error at the time of surgery. The forceps were only surgically removed from her body in September 2022, nearly five years later.

As a result, the police registered a case against the doctor and three healthcare workers under IPC Section 338 (whoever causes grievous hurt to any person by doing any act so rashly or negligently as to endanger human life).
