Pharma Firms Owe Govt Rs 8,526 Crore in Medicine Overcharging Dues, Panel Seeks NPPA Legal Cell
New Delhi: Pharmaceutical companies owed the government Rs 8,526.10 crore in outstanding overcharging demands as of September 30, 2025, prompting a Parliamentary Standing Committee to recommend that the National Pharmaceutical Pricing Authority (NPPA) examine the feasibility of establishing a dedicated legal cell to expedite long-pending litigation related to medicine overcharging.
The outstanding dues arise when pharmaceutical companies sell medicines above the maximum prices permitted by the government, and under the applicable provisions, companies are required to deposit the overcharged amount along with interest. The NPPA is the government authority responsible for fixing ceiling prices for essential medicines and monitoring medicine prices in the country.
According to the Parliamentary panel, ₹5,944.16 crore, accounting for nearly 70% of the pending amount, is locked in cases before the High Courts and the Supreme Court. Of the 345 court cases, as many as 280 have remained pending for six years to more than 20 years. The committee, which examined the Department of Pharmaceuticals under the Ministry of Chemicals and Fertilisers, asked the department and NPPA to take urgent measures to expedite these long-pending cases.
Another ₹2,581.94 crore remained unpaid in cases that had not yet reached the courts. These included matters referred to district collectors for recovery and cases in which pharmaceutical companies had challenged demand notices. The committee recommended a fast-track mechanism to resolve such disputes before they reach the courts.
The committee noted that NPPA currently relies on lawyers engaged on a contractual basis to contest overcharging cases. Considering the volume of pending litigation and the substantial amount involved, the panel recommended examining the feasibility of establishing a dedicated legal cell within NPPA for more effective and timely disposal of litigation. The committee also noted that pharmaceutical companies had challenged demand notices in 436 cases involving ₹2,358.20 crore. In its 33rd report on the functioning of NPPA, tabled in Parliament, the panel stated that as of September 30, 2025, the total demand stood at ₹10,013.30 crore, of which ₹8,526.10 crore, or approximately 85%, remained unpaid.
The Department of Pharmaceuticals informed the committee that companies had disputed several aspects of the demands. These included whether pricing rules had actually been violated, the methodology used to calculate the alleged overcharged amount, whether certain medicines came under price control, how trade margins should be considered and the manner in which interest should be calculated. While the department told the committee that companies were not exploiting loopholes, the panel observed that the repeated nature of these disputes demonstrated the need for clearer rules to reduce litigation.
The committee also raised broader concerns regarding India's medicine-pricing framework. It noted that non-scheduled medicines, which are not directly subject to price control, account for around 82% of the pharmaceutical market. Companies can determine the launch price of these medicines, while NPPA only regulates the extent to which their prices can be increased annually. The panel observed that this arrangement could enable companies to introduce new medicines at high prices and asked the Department of Pharmaceuticals to review the existing system.
The committee also questioned the limited public participation in determining prices of new medicines. Between December 2022 and November 2025, NPPA uploaded 1,426 draft price proposals for public comments but received only around 30 responses, with most responses coming from pharmaceutical companies.
The panel further pointed to gaps in the market data used by NPPA to monitor medicine prices. It noted that Pharmarack, the third-party vendor relied upon by NPPA for tracking medicine prices, does not capture data from hospitals, doctors who dispense medicines directly, Jan Aushadhi stores, trade generics or online pharmacies. The committee asked the Department of Pharmaceuticals to expand the scope of data collection so that medicine prices can be monitored more accurately, particularly in rural areas.
The report also highlighted staffing shortages within NPPA. Of the regulator's 48 sanctioned posts, 15 are vacant. The committee urged the department to fill the vacant positions at the earliest and also approve a proposal for creating 59 additional posts.
