Bombay High Court slams government on NORI issue

In response to the Writ Petition filed by MARD in the Aurangabad bench of Bombay high court, calling government's decision not to issue NORI certificate to doctors unconstitutional, the judges took cognisance of the points raised by MARD. Asking pointed questions to the advocate of Union of India, the honourable judges raised the points on whether the government is in position to provide jobs to every doctor and the fact whether our country is actually in the position of providing the upgraded facilities, seeking which doctors go abroad. The division bench of Justice Borde and Justice Bora, took strong note of the cause of MARD, stressing that  its important that we upgrade ourselves and its not right to have a sweeping ban like this. "Should the government of India rise to the level of the US of do you want to bring the doctors to the level of government of India," the court asked. The court also gave the example of the State of Maharashtra where the doctors have to go under compulsory bond service and yet the government is unsure of providing jobs.

The high court Suo Moto has made Medical Council of India, a party respondent to this petition and is reported to have given 7 days time to both Union of India and the MCI to file a reply affidavit. Additionally, the court ordered to delete the name of the health minister as one of the parties to the petition as he is not a necessary party to the present petition

The final decision is yet reserved an the bench has given the next date of hearing after 4 weeks

MARD had earlier filed a writ petition challenging the governments decision not to Issue NORI certificate to doctors  willing to go abroad with an exception of those above 65 years of age. The decision has not gone well with the medical community with objections coming from many doctors
