National Medical Commission
New Delhi: The National Medical Commission (NMC) has denotified the Maintenance of Standards of Medical Education Regulations 2023 (MSMER 2023) with immediate effect, while clarifying that the requirement of the Annual Disclosure Report (ADR) will continue.
The NMC stated that the de-notification will not affect actions already taken under the regulations, approvals and renewals granted, orders and decisions issued, or rights, obligations and liabilities accrued. Besides, applications, proceedings, appeals, inquiries and other matters pending immediately before the de-notification will continue to be dealt with under the 2023 regulations, insofar as applicable and subject to the provisions of the new notification.
However, the matters arising on or after the date of de-notification will be governed by the NMC Act, 2019, and the statutory and regulatory provisions in force at the relevant time.
The announcement was made through a recent gazette notification dated October 14, 2026, issued by Dr Raghav Langer, Secretary, NMC.
The apex medical regulator originally notified the regulations on September 19, 2023, and published them in the Gazette on September 21, 2023.
“In exercise of the powers conferred by section 10, 24, 25 and 57 of the National Medical Commission Act, 2019 (30 of 2019), read with section 21 of the General Clauses Act, 1897 (10 of 1897), the National Medical Commission hereby de-notifies the Maintenance of Standards of Medical Education Regulations, 2023 (MSMER-2023) which was notified vide Notification No. F. No. N-P016/1/2023-PGMEB-NMC dated 19th September, 2023 and published in the Gazette of India, Extraordinary, Part III, Section 4, No. 652, dated 21st September, 2023, with immediate effect,” the Gazette notification announced.
While de-notifying the regulations, the Commission has specifically retained the requirement to furnish Annual Disclosure Reports under Sections 24(i) and 25(h) of the NMC Act, 2019.
“Notwithstanding such de-notification, the requirement of furnishing the Annual Disclosure Report (ADR) shall continue to operate in accordance with Section 24(i) and 25(h) of the National Medical Commission Act, 2019 and the regulations applicable from time to time,” the notification read.
"Notwithstanding the de-notification of the Maintenance of Standards of Medical Education Regulations, 2023 shall not affect-
(a) any action duly taken or purported to have been taken under the said Regulations before the date of their de-notification;
(b) any approval, renewal, order, decision or direction duly granted, issued or made under the said Regulations before the date of their de-notification;
(c) any right, privilege, obligation or liability acquired, accrued or incurred under the said Regulations before the date of their de-notification;
(d) any application, proceeding, appeal, inquiry or other matter pending immediately before the date of their de-notification, which shall be continued and disposed of in accordance with the provisions of the said Regulations, insofar as applicable, and subject to the provisions of this Notification:
Provided that any matter arising on or after the date of de-notification shall be governed by the provisions of the National Medical Commission Act, 2019 and the statutory and regulatory provisions in force at the relevant time."
"This Notification shall come into force on the date of its publication in the Official Gazette," the NMC said.
