NMC rejects pending applications of 2316 Medical Students Abroad seeking eligibility certificate

New Delhi: The National Medical Commission (NMC) has closed and rejected the pending applications of 2316 students pursuing medical courses abroad who sought issuance of eligibility certificates. This decision has been taken in view of the non-submission of requisite documents/information and clarifications from respective applicants.

Issuing a notice, the Ethics and Medical Registration Board (EMRB) of NMC mentioned that these students were given ample time to correct the concerned deficiencies and to submit the applications with fulfilment of deficiencies.

However, considering that no deficiencies were rectified by the candidates, the NMC has now closed their applications which have been pending with the initiator. The list of the students whose applications have been rejected has been attached along with the notice linked below.

The NMC stated that some applications for issuance of eligibility certificates are pending with the applicant only (pending with the initiator) for a long time (more than 10 months) due to non-submission of requisite documents/information and clarifications from respective applicants.

In this Connection, the NMC invited the attention to section 13(4B) Indian Medical Council Act, 1956 which states that:-

"(4B) A person who is a citizen of India shall not, after such date as may be specified by the Central Government under sub-section (3), be eligible to get admission to obtain medical qualification granted by any medical institution in any foreign country without obtaining an eligibility certificate issued to him by the Council and in case any such person obtains such qualification without obtaining such eligibility certificate, he shall not be eligible to appear in the screening test referred to in sub-section (4A): Provided that an Indian citizen who has acquired the medical qualification from foreign medical institution or has obtained admission in foreign medical institution before the commencement of the Indian Medical Council (Amendment) Act, 2001 shall not be required to obtain eligibility certificate under this sub-section but, if he is qualified for admission to any medical course for recognized medical qualification in any medical institution in India, he shall be required to qualify only the screening test prescribed"

The NMC further pointed out that the requirement of taking the eligibility certificate before proceeding abroad has been dispensed with w.e.f. 05 June 2019 “after which NEET UG qualification shall be deemed to be treated as Eligibility certificate.” At this outset, the commission observed that applicants whose name is mentioned in the Annexure listing the 2316 candidates have proceeded and studied abroad without obtaining an Eligibility Certificate.

In view of this, on April 18, 2023, a public notice was posted stating that all applicants who have not fulfilled the deficiencies in their applications would be given 30 days to do so. The deadline for this was May 18, 2023.

NMC had published a list of 2875 such candidates whose applications were pending with the initiator and the commission warned that if the deficiencies are not rectified in time, all such applications will not be further considered and pending applications will be treated as closed.

It has now been more than 4 months since the public notice was posted and the applicants have still not fulfilled the deficiencies in their applications. “The applicants have had ample time to correct/complete deficiencies and to submit the applications with fulfilment of deficiencies. However, they have not done so,” the NMC said.

Nullifying such pending applications, the NMC announced,

“In this regard, it may be noted that above said candidates did not fulfil the deficiencies within the prescribed time frame and now their applications have been stands closed/rejected.”
