HC reserves one seat at GMC Jammu for MBBS aspirant who could not pay online fee

Jammu: The High Court of Jammu and Kashmir at Ladakh recently came to the aid of a medical aspirant whose name was not in the provisional merit list of Jammu and Kashmir Board of Professional Entrance Examinations (BOPEE) for the failure of paying the online fee.

Taking note of the submission of the petitioner that her transaction could not be completed, the bench directed the UT Government and other authorities to keep one seat reserved for the medical aspirant at Government Medical College, Jammu.

"Taking into consideration the overall facts of the present case, it is directed that one seat be kept reserved in the SC category in Government Medical College, Jammu for MBBS course. The petitioner shall be allowed participation in the counseling process as and when the next phase of the same takes place," read the order.

Listing the matter for further hearing, the bench comprising of Justice Puneet Gupta has further directed the Government and other authorities to file objections by the next date.

The case concerned the petitioner Sangeeta Devi, whose name figured at the provisional merit list at serial no. 2273 in pursuance to the advertisement notice issued for NEET. Her name, however, did not figure in the provisional list issued by the BOPEE purportedly for the reason that the fee of Rs 1500, which was required to be deposited online in terms of BOPEE notification dated 30.01.2022 had not been deposited.

It was submitted by the petitioner that she had paid the amount online on 03.02.2022 but the transaction could not be completed. She had also been chosen successfully of her choice of preference in the Government Medical College, Jammu for admission to MBBS course.

Taking note of the submissions made by the petitioner, the HC bench observed, "It appears that the name of the petitioner does not figure in the provisional list of candidates of Notification dated 27.02.2022 for the reason that she has not deposited the requisite fee of Rs.1500/- in terms of the Notification."

"Keeping in view the aforesaid fact that the name of the petitioner figures in the provisional list of successful candidates for the MBBS course, the interim directions are required to be passed in the petition," further opined the bench.

So, the bench directed to keep one seat reserved for the petitioner MBBS aspirant at GMC Jammu.
