NEET Counselling: Bombay HC directs NTA to declare retest results of 2 candidates, allows round 1 participation

Mumbai: Considering the fact that the registration window for Maharashtra's Centralised Admission Process (CAP) has already closed, the Bombay High Court has granted immediate relief to two R-NEET UG 2026 candidates who could not participate in the admission process by directing the National Testing Agency (NTA) to declare their results.

Noting the urgency of the case, the division bench comprising Justice R. I. Chagla and Justice Firdosh P. Pooniwalla also allowed the candidates to participate in CAP Round 1 through offline registration, giving them an opportunity to enter the admission process.

The Court passed the interim order while hearing a writ petition filed by 2 candidates, whose results for the Re-NEET (UG) 2026 examination held on June 21, 2026, had not been declared.

The petitioners told the Court that while the results of other candidates who appeared for the June 21 examination were declared on July 16, their results continued to be withheld.

The matter was brought before the High Court on an urgent basis as, according to the admission schedule, candidates were required to report or join by August 22, while the revised Registered Candidates List was scheduled to be published on August 23.

The court also took note of the revised CAP-1 schedule submitted by the State CET Cell. As per the revised schedule, online/offline registration and the related session had been scheduled from August 20 to August 21, up to 8 PM.

The learned counsel for the petitioners pointed out that the show cause notice which was issued to the petitioners by the NTA on July 15 was related to the NEET UG 2026 examination conducted on May 3 and a complaint made on June 15. However, the petitioners were seeking declaration of their results for the separate Re-NEET examination conducted on June 21.

The bench was also informed that the petitioners had already submitted their replies to the show cause notices, but no further action had been taken by the NTA.

During the hearing, the petitioners relied on an earlier order passed by the Aurangabad Bench of the Bombay High Court in similar cases, where the same complaint was considered and the CBI subsequently filed a charge sheet on July 28. The petitioners in that case were not named as accused and were instead named as witnesses. 

"The CBI had no objection for declaration of results of the petitioners. The Aurangabad bench of this Court considered that, as per schedule, 12th August 2026 is the last date for filing admission form and accordingly, directed Respondent No.2 NTA to declare the results of the petitioner by the next date viz. 11th August 2026 by 11 a.m," the counsel informed the court. 

Considering that the present petitioners were similarly placed, the Bench decided to pass a similar interim order.

Accordingly, the bench directed the NTA to declare the Re-NEET UG 2026 results of both petitioners on August 21 and permitted them to participate in CAP Round 1 for MBBS/BDS admissions by registering through offline mode.

Along with this, the Union Government has been directed to file its reply to the petition by August 28, while the matter has been listed for further consideration on September 11, 2026.

"This order is subject to the outcome of the present petition and the petitioner shall not claim any equities by virtue of this order being passed," the court said in conclusion.
