MUHS issues notice on Procedure For Scrunity of Inspection, Compliance Report For UG, PG medical Courses, details

Maharashtra: Maharashtra University of Health Sciences (MUHS) has released the rules of procedure for scrutiny of Inspection (LIC) reports, compliance reports of deficiencies, verification of compliance reports and Hearing for UG and PG courses.

Whereas as per the provision contained in sub-section (1), (n), (z) and (II) of section 5 of the Maharashtra University of Health Sciences Act, 1998 (hereinafter referred to as the "said Act"), the University shall have powers and duties with regard to affiliation of Health Sciences Colleges in the State;

And whereas as per the provisions contained in sub-section (7) of section 65 of the said Act, the procedure referred to in subsection (1) and (4) of section 65 shall apply, mutatis mutandis, for the consideration of continuation of affiliation, from time to time, and accordingly, the affiliated college or recognised institution shall be required to apply for continuation of affiliation or recognition for every academic year, for the courses of study for which affiliation or recognition was granted;

And whereas, such affiliated colleges and recognised institutions shall ordinarily apply for continuation of affiliation or recognition, at least six months before the date of expiry of such affiliation or recognition or the previous continuation of affiliation or recognition, as the case may be;

And whereas prescribing the procedure for continuation and/or Extension of affiliation of existing Health Sciences Colleges and the institutions with the University is a subject matter of Statute as the provisions of section 48 of the said Act;

And whereas there is no Statute prescribing the procedure for the Continuation and/or Extension of affiliation of existing colleges of Health Sciences and the institutions with the University;

And whereas making of Statutes is time taking process, and therefore, the Vice-Chancellor of the University, in the exercise of powers conferred upon him under sub-section (8) of section 16 of the said Act, issued Direction No. 02/2016, namely "Procedure for grant of continuation and I or extension of affiliation to existing affiliated health sciences colleges (undergraduate and postgraduate) and recognised institutions with Maharashtra University of Health Sciences";

Now, therefore, I, Lt. Gen. Madhuri Kanitkar (Retd.) (PVSM, AVSM, VSM), Vice-Chancellor of the University, in the exercise of powers conferred upon me under sub¬section (8) of section 16 of the said Act and under sub-rule (4) of rule 17 of Direction No 02/2016 issue the following direction prescribing the additional rules of procedure of scrutiny of local inspection committee (LIC) reports, compliance report of deficiencies, verification of compliance report and the procedure of hearing in consonance with the rules prescribed vide Direction No. 02/2016 –

1. Short title, extent and commencement -

(1) This Direction may be called the "Rules of procedure of scrutiny of Inspection (LIC) reports and Hearing."

(2) It shall come into force with effect from the date of its issue.

(3) It extends to all the existing affiliated Under Graduate and Post Graduate colleges and the recognised institutes.

(4) It also extends to all the existing affiliated colleges and the recognised institutes imparting Ph.D., fellowship and certificate courses for the purpose of scrutiny of local inspection committee (LIC) reports and the procedure of hearing.

2. Definitions -

Words or expressions used but not defined in this Direction shall have the same meaning, respectively, assigned to them in the said Act and Direction No. 02/2016.

1 Additional rules for Scrutiny of L.1.C.'s reports -

(1) The scrutiny of the compliance report of the deficiencies pointed out by the Academic Council or the University shall be done by appointing a committee

(2) The constitution of the committee shall be as follows -

a) One expert person having a minimum of 10 years of approved teaching experience as Associate Professor or Professor nominated by the Vice-Chancellor.

b) Head of the academic section of the University.

4. Additional rules for Compliance report of deficiencies and verification of compliance report -

(1) The University shall offer only three opportunities to the college or institute to submit compliance report of the deficiencies pointed out by the Academic Council or the University. Such three opportunities shall be offered prior to the cut date for admissions declared by the appropriate authority for the concerned academic year.

(2) In ordinary circumstances, no further opportunity shall be offered to the concerned college or institute to submit a compliance report after the submission of the third compliance report for the concerned academic year.

5. Additional rules for Procedure for hearing -

(1) If it reflects from the first compliance report submitted by the concerned college or institute or from the report of the compliance verification committee that the deficiencies pointed out by the Academic Council or the University are not fully or properly rectified by the concerned college or institute, the first opportunity of hearing will be offered to the management and the Dean or the Principal of the concerned college or institute before the first hearing committee constituted as follows - 

a) The Dean of the concerned faculty or, in the absence of the Dean of the concerned faculty, one member of the Academic Council nominated by the Vice-Chancellor— Chairman

b) The Head of the Academic Department of the University Member

c) The Head of the Law Department of the University — Member

d) The concerned faculty head under the Academic Section — Secretary.

(2) If the committee is satisfied after the first hearing and concludes that the college or institution has rectified all or major deficiencies pointed out by the Academic Council, the committee shall record such recommendations and submit it to the Vice-Chancellor for further necessary action. The Vice-Chancellor, on behalf of the Academic Council, may grant continuation and/or extension of affiliation to the concerned college or institution by stipulating certain conditions, as he/she deems fit and by imposing a fine which may not exceed rupees twenty-five thousand.

(3) If the committee is not satisfied after the first hearing and concludes that the college or institution has not rectified all or major deficiencies pointed out by the Academic Council, the committee shall record such observations and submit it to the Vice-Chancellor for further necessary action. After approval of the Vice-Chancellor, such deficiencies shall be communicated to the concerned college or institution for its rectification and submission of a compliance report of such deficiencies.

(4) After receipt of the second compliance report submitted by the concerned college or institute, the second opportunity of hearing shall be offered to the management and the Dean or the Principal of the concerned college or institute before the second hearing committee constituted as follows;

a) The Pro-Vice-Chancellor or, in the absence of the Pro-Vice Chancellor, the Dean of the concerned faculty — Chairman

b) The Head of the Law Department of the University — Member

c) The Head of the Academic Department of the University — Member —Secretary

(5) If the committee is satisfied after the second hearing and concludes that the college or institution has rectified all or major deficiencies pointed out by the Academic Council, the committee shall record such recommendations and submit it to the Vice-Chancellor for further necessary action. The Vice-Chancellor, on behalf of the Academic Council, may grant continuation and/or extension of affiliation to the concerned college or institution by stipulating certain conditions, as he/she deems fit and by imposing a fine which may not exceed rupees fifty thousand.

(6) If the committee is not satisfied after the second hearing and concludes that the college or institution has still not rectified all or major deficiencies pointed out by the Academic Council, the committee shall record such observations and submit it to the Vice-Chancellor for further necessary action. After approval of the Vice-Chancellor, such deficiencies shall be communicated to the concerned college or institution for its rectification and submission of a compliance report of such deficiencies.

(7) After receipt of the third compliance report submitted by the concerned college or institute, the third opportunity for a hearing will be offered to the management and the Dean or the Principal of the concerned college or institute before the hearing committee constituted as contemplated under rule 14 Direction No 02/2016.

(8) If the committee contemplated under rule 14 of Direction No. 02/2016 is satisfied after the third and final hearing and comes to the conclusion that the college or institution has rectified all or major deficiencies pointed out by the Academic Council, the Vice-Chancellor, on behalf of Academic Council, may grant continuation and/or extension of affiliation to the concerned college or institution, by stipulating certain conditions, as he deems fit and by imposing a fine which may not exceed One Lakh rupees.

(9) The summary of decisions taken after the hearing regarding the continuation and/or extension of affiliation to the concerned colleges or institutions shall be submitted in the ensuing meeting of the Academic Council for discussion and confirmation.
