Telangana HC junks pleas seeking cancellation of MBBS seats allotted in stray round counselling

Hyderabad: The High Court of the Telangana High Court on Wednesday dismissed a batch of petitions, which sought directions to set aside the undergraduate medical seats (MBBS and BDS0 allotted in the stray vacancy round by the Kaloji Narayana Rao University for Health Sciences.

Although the petitioners alleged that during the stray counselling, the University deliberately allotted seats to candidates who had participated and joined seats in phases 1, 2, and 3, after considering the plea, the HC Division bench comprising Chief Justice Alok Aradhe and Jukanti Anil Kumar opined that there were no latches in the seat allocation process in the stray vacancy round.

One of the petitioners, K.T. Sai Revanth Reddy approached the Court praying for an order declaring the action of KNRUHS University in deliberately alloting seats in stray vacancy round counselling to candidates who have already participated and joined seats in Phase I Phase Ii and Phase III in complete defiance of the modified procedure issued by the Directorate General of Health Services, Ministry of Health and Family Welfare and also violating the Supreme Court order.

It was also alleged by the petitioner that the names of the candidates, who secured admission in various phases, were to be eliminated in the software used for the stray counselling. However, the University allegedly did not comply with the provision and deliberately conducted the stray counselling by including the names of the candidates, who had already secured seats.

Therefore, the petitioner also sought a direction upon KNRUHS to prepare a seat matrix and merit list afresh by including only the candidates who did not get any seats in the previous round of counselling and conduct stray vacancy round counselling afresh and allot seats in accordance with the modified procedure issued by DGHS.

As per the latest media report by Deccan Chronicle, responding to these contentions raised in the plea, the counsel for the University refuted the same and submitted to the Court that the already selected students will remain in their respective colleges only. He added, "There will not be any change even after the stray round admissions."

"As students exercised their web options in the first two rounds of counseling, though the subsequent rounds did not allow their participation, the software program changed their category in tune with their original options," the KNRUHS counsel further informed the Court.

Besides, he also explained to the HC bench that the unreserved seats which were vacated by the students in the sliding method were filled by local candidates. The category of students who had already joined in previous rounds of counselling will get slided in tune with their option. Therefore, in the current case, the student who joined Osmania Medical College will remain there only.

Taking note of the submissions by the counsel for KNRUHS, the HC bench opined that there are no latches in the stray round allocations and accordingly dismissed the petitions.
