Alleged Discrimination, violation of duty hours of PG medicos- NCSC issues notices to Health Ministry, AIIMS

New Delhi: The allegations of discrimination and violation of duty hours of postgraduate medical students will now be examined by the National Commission for Scheduled Castes.

In this regard, the Commission has already issued notices to the Union Ministry of Health and Family Welfare and the Director of the All India Institute of Medical Sciences (AIIMS), New Delhi.

The Commission took cognisance of the issue after receiving a representation from Dr. Lakshya Mittal, a Laparoscopic, General & Laser Surgeon and the Chairperson & National President of the United Doctors Front (UDF), who urged the Commission to protect the SC PG medical students from rights violations and discrimination.

Writing to the Secretary of the Health Ministry and the Director of AIIMS, the Commission wrote, "Whereas a Petition/complaint/information has been received by the National Commission for Scheduled Castes from Shri/Smt Dr Lakshya Mittal dated 08/07/2025 as enclosed and the Commission has decided to investigate/inquire into the matter in pursuance of the powers conferred upon it under Article 338 of the Constitution of India."

Seeks details in this regard, the Commission further added in the letter, "You are hereby requested to submit the facts and information on the action taken on the allegations/matters to the undersigned within 15 days of receipt of this notice either by post or in person or by any other means of communication."

"Please take notice that in case the Commission does not receive reply from you within the stipulated time, the Commission may exercise the powers of Civil Courts conferred on it under Article 338 of the Constitution of India and issue Summons for your appearance in person or by a representative before the Commission," it warned.

"After our representation, National Commission for Scheduled Castes @NCSC_GoI has issued notice to Secretary @MoHFW_INDIA & Director @aiims_newdelhi over alleged discrimination & violation of duty hours of PG medical students. Team @UDF_BHARAT will ensure no student is silenced," Dr. Mittal wrote in an X post.

Medical Dialogues had earlier reported that the doctors under the United Doctors' Front (UDF) had filed a Public Interest Litigation (PIL) in the Supreme Court against the "inhumane working hours of resident doctors". The association challenged the "exploitative and unconstitutional working conditions imposed on resident doctors across the country".

The plea, filed through Advocates Mr. Satyam Singh, and Ms. Neema AOR, has sought urgent intervention from the Apex Court to enforce compliance with the Ministry of Health and Family Welfare's 1992 directives notification, which mandates that resident doctors should not work more than 12 hours per day and 48 hours per week.
