Doctor booked after patient arrested for extortion files complaint alleging molestation

The incident that took place a month back.

As per a recent media report in Times of India, the police hasn't made any arrests yet since they are still investigating the authenticity of the complaint.

The doctor had earlier filed complaint against the patient and four of her associates for extorting money from him, in which they were arrested.

On December 19, the police had arrested the 30 year old woman and her accomplices on the basis of the doctor's complaint for assaulting and blackmailing the doctor and extorting Rs 2 lakh from him.

The incident took place on November 18, where the 53 year old doctor said that the woman had consented to intimacy, however had filmed them together without him knowing. After that, she came into the clinic with a person whom she identified as her husband and three others. The group created a huge ruckus and beat up the doctor. They demanded an amount of Rs 2 lakh from him, and stayed in the clinic late till the next day, until the doctor paid them the money.

After some time had passed, they harassed him again for Rs 50000. He then decided to go to the police.

The police told TOI that the doctor, who runs a clinic at sector 3 in Charkop, Kandivli West had filed a complaint at the police stating that he was harassed and beaten up by six people in his clinic, who also extorted money from. Following this, the police had arrested the woman and her accomplices.

The police during their probe got to know that the person who identified as the woman's husband was not really her husband. Four persons involved with the case were arrested, while the fifth one is on the run. The accused were initially remanded in judicial custody and were eventually granted bail.

As per a media report in the Mid-Day, the complaint was filed by the woman against the doctor after coming out on bail. She stated that the doctor had touched her inappropriately during the check-up. One of the accused said, "The allegations against us are false because we are the victims. Instead of taking our complaint, the police made us accused in the case. The doctor has misbehaved with many women patients, due to which he was beaten up. His license should be cancelled and he should be arrested."

Pravin Padwal, Additional Commissioner of police (North Mumbai) told Mid-Day, "There is a provision in law that if a complaint is registered, it should be investigated. The victim alleges that the doctor molested her, so we have registered an FIR."

The doctor stated, "This is a racket and everything was planned. The police have arrested four people so far and recovered some of the amount they extorted from me. Two accused involved in the case are still absconding. I am a victim in this case."

Advocate Vishal Satyaprakash Saxena added, "One can register a counter FIR at the nearest police station and both the matters shall be investigated separately. However, both the cases shall be adjudicated by the same judge, as the matter is in the form of counter-cases arising out of the same cause of action", adding, "Several laws are being misused today. The current FIR cannot sustain in the eyes of the law, as there's already an FIR for extortion registered against her and others. Coming out on bail and fulfilling personal vendetta in order to further the acts of extortion is nothing but a clear act of misusing the police machinery and law. Such people shouldn't be entertained by the law enforcing machinery, rather be penalised under Sections 182 and 203 of the IPC."
