Ludhiana: Doctor commits suicide, two accused sentenced to 5 years jail for abetment

Ludhiana: In response to the suicide of a doctor, the court has convicted two accused persons of five years of jail and a fine of Rs 20,000. They were arrested under Section 306 (abetment of suicide) of the Indian Penal Code (IPC). 

The case was ruled by Additional Sessions Judge Vijay Kumar who after analysing all the evidence delivered the verdict. The allegation against the accused was successfully proven by the prosecution without any doubt, said the court. Moreover, The court also denied the accused's plea for leniency.

The accused have been identified as Jaswinder Singh, alias Monu Walia, who is a resident of Krishna Nagar and Gurinder Singh, alias Ginni who is a resident of Anand Nagar, Khanna.

The deceased has been identified as Gurwinder Singh. As per The Tribune information, the incident took place when the doctor had earlier taken a loan from the duo who allegedly pressured him to repay the money. The matter took a big turn when both the accused decided to visit the doctor's house and insult him on June 17, 2008. Feeling pressured and depressed, Dr. Singh decided to commit suicide.

Following the suicide, the deceased father, Jang Singh went to the City police station in Khanna and filed a case against the duo. The police later registered the case on June 21, 2008.

No solid evidence was found against them by the police leading to the delay of the case but soon after the complainant complained and asked the police to look over the case immediately. The accused was then summoned to the court.

While the accused was on trial, he claimed false accusations and declared himself innocent. In the end, the court found them guilty and sentenced them accordingly after reviewing the evidence.

According to the 306 section of the Indian Penal Code, a person abetting the suicide of another person shall be punished with imprisonment up to 10 years and shall also be liable to fine. Abetting a suicide is a non-bailable charge.

A person is guilty of abetment when:

1) He instigates someone to commit suicide (or)

2) He is part of a conspiracy to make a person commit suicide (or)

3) He intentionally helps the victim to commit suicide by doing an act or by not doing something that he was bound to do
