Maharashtra: 2 Orthopedicians from Apollo, Ekayan hospital booked for medical negligence in treatment of Constable

Thane: Two orthopedic surgeons, one attached to Apollo Hospital and the other to Ekayan hospital, Navi Mumbai, have been booked by the police in a case of alleged medical negligence in the treatment of a police constable. The move comes after a report from the district Civil Surgeon appointed to look into the matter confirmed medical negligence in the treatment of the constable.

The move comes a day after the wife of a police constable tried to attempt suicide, alleging medical negligence in surgeries of her husband at two private hospitals last year in Navi Mumbai, which caused major suffering and disability to the husband since one year.

Two doctors were booked for alleged negligence after complaints by a police constable were verified by local health authorities in Navi Mumbai, an official said on Thursday. The two doctors are orthopedics, one from Apollo Hospital and another from Ekayan Hospital.

As per media account, the accident of the constable took place in February last year when 35-year-old constable Hanumant Davare attached to Seawoods traffic unit, suffered injuries after a speeding car rammed into him when he was on nakabandi duty with three colleagues at TS Chanakya Chowk on Palm Beach Road.

Following this, he was rushed to Apollo Hospital and underwent surgeries for fractures on his thigh and arm on February 15, where the first doctor l operated on him.  It was alleged that despite complaints of pain by the patient, the doctor discharged him from the hospital.

Explaining this, the victim to the media, "Even though I was in extreme pain, I was told to get discharged on February 17. I had not recovered, but I was almost threatened to take immediate discharge. I realized that it was done to save the accused so that they could fight for his bail, claiming that the victim received minor injuries and have got discharged."

He informed HT, "If the hospital admission period extended beyond a week, more stringent sections could be added and his bail could be denied. On February 18, since I did not get discharged, the hospital stopped giving me medicines and treating me, thus forcing me to get discharged."

The constable then consulted another doctor, who referred him to undergo neurological tests at a hospital in Seawoods. The test reports showed that the patient suffered from post-operative complications of Radial Nerve Neuropraxia.

As per statements of the victim, he started to see changes after the second doctor conducted surgery following a physiotherapy session. Therefore, he claimed that he had not made allegations against the doctor. 

"Dr Vanjari said that the plate insertion in my thigh and arm was not done properly and another surgery was required. On March 7, I underwent another operation," Davare said. 

"Since the report from the civil surgeon mentioned negligence from Dr Vanjari as well, it was obligatory on our part to mention his name. In further investigations, if we find there is no negligence, we can take appropriate action," Giridhar Gore, senior police inspector, CBD Belapur police station, said. 

As per the report, the second doctor should not have conducted surgery immediately after the first surgery and should have let natural recovery happen.

Denying the allegations, the second doctor informed Hindustan Times in his defence, "I have done my job as best as possible. And my diagnosis was right and accurate. I am just being made a scapegoat. The neurology report said that he needed immediate surgery as his nerve was compressed. He could not move his hand when he had met me; now he is able to walk slowly. When they came to me, they looked very scared and hence I just followed my oath that no one should be in pain."

It is reported that the CBD Belapur police had written to the District Civil Surgeon, Thane on December 31, 2022, to enquire into the matter. On January 5 this year, the surgeon submitted a reply to the police in which he alleged negligence on the part of the two doctors.

Cases were registered under Indian Penal Code sections 336 (Act endangering life or personal safety of others) and 337 (Causing hurt by act endangering life or personal safety of others) for rash and negligent acts as well as other offenses against the two doctors, the CBD police station official said.

"The cases were registered after a report from the Thane civil surgeon's office verified the constable's complaint. No arrest has been made," he added.
