Stone diagnosed in Right kidney, Surgery performed on left: Ludhiana Surgeon booked 2 years after alleged botched surgery

Ludhiana: Acting on a complaint of medical negligence in a kidney stone removal surgery, the Sadar police have recently booked a Ludhiana-based surgeon, who runs a hospital at Gill Road.

According to HT report, the patient alleged that even though a stone was diagnosed in his right kidney, the doctor performed surgery on his left kidney. Further, the patient alleged that he had suffered some severe complications after the surgery and consequently he was confined to bed for the past two years.

The matter was examined by a panel of doctors formed by the Health Department. After the panel submitted a report, police lodged a first-time report (FIR) and booked the concerned doctor.

As per the 52-year-old complainant, he was diagnosed with a stone in the right kidney back in 2022. He approached the treating hospital on April 8, 2022, and the treating doctor advised him to get admitted to the hospital. He mentioned that he underwent the surgery on the same day.

According to Hindustan Times, the patient's brother-in-law informed that the complainant suffered complications during the surgery and thereafter he had to be taken to Hero DMC Heart Institute, a unit of Dayanand Medical College and Hospital (DMCH). After being discharged from the said hospital, the patient again got admitted to the hospital of the treating doctor. Even though the patient remained admitted for 15 days, his condition, allegedly, did not improve in those 15 days.

It was further stated that the doctor charged Rs 1.1 lakh for treatment, Rs 55,000 for the surgery and he also claimed another Rs 1 lakh from his medical insurance.

Commenting on the matter, the patient's wife informed The Tribune, "Dr *** prepared a total bill of Rs 2.25 lakh, but after request, he agreed to take Rs 1.50 lakh. After getting discharge from Dr *** hospital, my husband again faced severe pain in his abdomen. During medical check-up, stones were again detected in his kidney. Then we realised that Dr *** had not removed kidney stones. We then approached the Civil Surgeon, who formed a panel, which held Dr *** responsible for the poor health condition of my husband. We also lodged complaint with the police after which and FIR was registered against Dr ***."

HT adds that the patient filed the complaint before the police and health authorities on March 13, 2023. Following this, the Health Department set up a panel of doctors to examine the matter. Based on the committee report, the police lodged an FIR against the concerned doctor.

Assistant sub-inspector (ASI) Iqbal Singh, who is investigating the case, informed the HT that the doctor was booked under sections 192 (fabricating false evidence), 193 (punishment for false evidence), 417 (punishment for cheating), 418 (cheating with knowledge that wrongful loss may ensue to person whose interest offender is bound to protect) and 420 (cheating with knowledge that wrongful loss may ensue to person whose interest offender is bound to protect) of the Indian Penal Code (IPC). However, so far, no one has been arrested.

Meanwhile, the concerned doctor refuted all the allegations and he informed HT that the patient suffered a post-operative strike and thereafter was rushed to Hero DMC Heart Institute, following which the patient remained in his hospital for at least 15 days. The doctor claimed that there was no negligence on his part. He also mentioned that he had produced all proof before the board of doctors formed by the Health Department.
