Andhra Pradesh Govt constitutes special board to implement Surrogacy and Assisted Reproductive Technology Act-2021
Andhra Pradesh: In a move to strengthen the ART and Surrogacy in the state, the Andhra Pradesh Government has constituted the State Assisted Reproductive Technology and Surrogacy Board under the Surrogacy (Regulations) Act, 2021.
Besides this, in addition, the Government has notified the appointment of state and district Appropriate Authority for surrogacy and associated reproduction.
Medical Dialogues team had earlier reported that the Central Government has established the National Assisted Reproductive Technology and Surrogacy Registry under the Department of Health Research for the purposes of the Assisted Reproductive Technology (Regulation) Act, 2021 and the Surrogacy (Regulation) Act, 2021.
The National ART and Surrogacy Registry (NARTSR) will act as an online public record system of ART Clinics/Banks and Surrogacy Clinics in India. It will also act as a Central Database of all the ART Clinics, Banks and Surrogacy Clinics in the country through which the details of all the clinics and banks of the country including the nature and types of services provided by them, the outcome of the services and other relevant information shall be obtained on regular basis.
The Registry is led by the Hon'ble Cabinet Health Minister- Dr Mansukh Mandaviya, Hon'ble Minister of State- Dr Bharati Pravin Pawar and Secretary DHR- Prof. Balram Bhargava.
An Andhra Pradesh Gazette notification dated 11th July 2022 issued by the Health, Medical and Family Welfare Department has notified the creation of the National Assisted Reproductive Technology and Surrogacy Registry under Assisted Reproductive Technology (Regulation) Act, 2021 and the Surrogacy (Regulation) Act, 2021.
In exercise of the powers conferred by the provisions under section 6 of the Assisted Reproductive Technology (Regulation) Act, 2021, which has been constituted under section 26 of the Surrogacy (Regulation) Act, 2021 issued in G.O.Ms.No.181, HM&FW (E2) Department, dated 08.07.2022, shall be the state Board for the purposes of ART (Regulation) Act and under clauses (a) and (b) of sub-section (2) of section 35 of the ART (Regulation) Act, Government of Andhra Pradesh hereby constituted the State Appropriate Authority for ART, for implementation of the ART (Regulation) Act in the state, the notification said.
The Commissioner/Director of Health and Family Welfare; A.P has been appointed as the member secretary.
Besides this, the State Appropriate Authority for ART Act comprises the AP Commissioner/Director of Health and Family Welfare Department will be the Chairman and the Additional Director (MCH) will be the Vice Chairman. The government has appointed three women Smt. Padmalatha, NGO, Swarajya Abhyudaya Sewa Samithi from East Godavari, The Additional /Joint Secretary, Law and Legal Affairs Deptt., A.P. and Dr.D.Sarada, MBBS, DGO., Satyasai Nursing |Member Home, Tenali, Guntur District as members of the board.
At the District level, the Collector will be the Chairman and the District Medical Health Officers (DMHO) will function as the Vice-Chairman with three other members comprising of n eminent woman representing a women's organization (nominated by the District Collector & DM&HO), The Additional District judge (nominated Member by the District Judge), and An eminent registered medical practitioner (nominated by the District Collector & DM&HO).
The notification further added that the Board and Authorities shall have power, functions, terms and conditions as specified in the respective act.
