Telangana High Court Rules Aadhaar Card Not Required for Admission in Hospitals

Hyderabad: In response to the Public Interest Litigation (PIL) filed by Srinivas Byreddy, the Telangana High Court clarified on Friday that an Aadhaar card is not mandatory for the admission of patients in government hospitals.

The PIL Bench, comprising acting Chief Justice Sujoy Paul and Justice Renuka Yara, examined the case after Byreddy, a practicing advocate alleged that the Osmania General Hospital (OGH) had refused treatment to a woman for failing to present an Aadhaar card. The petitioner’s counsel informed the court that the woman was turned away because she did not present her Aadhaar card during her visit to the hospital.

The PIL alleged that the requirement of an Aadhaar card for admission and treatment at OGH was illegal, arbitrary, and a violation of constitutional rights under Articles 14 (Right to Equality), 19 (Freedom of Speech and Expression), and 21 (Right to Life and Personal Liberty).

As per the news report by TNIE, the PIL also requested the court to direct all government hospitals in Telangana to admit and treat patients without making the submission of an Aadhaar card mandatory.

However, the Government Pleader countered these claims, presenting medical records that indicated the woman was eventually admitted and treated despite not disclosing her Aadhaar information.

According to Telangana Today, the Government Pleader also informed the court that the government hospitals are duly admitting and treating the patients without mandatorily insisting on producing Aadhaar cards. Recording the said submissions, the Bench disposed of the matter.
