Gynaecologist found guilty of medical negligence, hospital closure notice issued

Thane: The Thane Municipal Corporation (TMC) has issued a closure notice to the hospital run by a gynaecologist following a medical inquiry committee’s report that found him guilty of medical negligence in the death of a 35-year-old woman in 2022. 

The civic body has directed the gynaecologist to transfer all existing patients to other hospitals and cease operations immediately. It further warned that failure to comply would result in the hospital being sealed.

The decision comes after the committee’s investigation revealed that the gynaecologist, Dr ***, failed to provide timely treatment and personal supervision to the patient, identified as Patil.

The incident, which occurred on October 9, 2022, began when Patil was rushed to the hospital due to fluid loss during pregnancy. However, doctors allegedly delayed treatment, resulting in the death of her unborn child in the uterus. The subsequent delay in removing the fetus reportedly led to a severe infection, which spread through her body, triggering multiple organ complications.

She was later shifted to Jupiter Hospital for an abortion procedure, but by then, the infection had severely affected her kidneys, leading to organ failure. Her condition deteriorated, and on October 12, 2022, she was declared dead.

Talking to Free Press Journal, the gynaecologist said, "I have already filed an appeal with the health ministry at Aarogya Bhawa against the closure order. Under the Bombay Nursing Home Act, there is no provision to shut down a hospital in a medico-legal case.” 

Advocate Mohammad Shine told the Daily, “We are happy that the corporation has taken cognizance of this serious incident and taken necessary action. However, the fight for justice for the deceased’s family does not end here. The cases filed before the Hon’ble District Consumer Commission and the Human Rights Commission continue.”
