Once again, MCI warns against MBBS course at Singhania University

The warning is pursuant to the recent advertisement published by the Singhania University, Pacheri Bari, Distt. Jhunjhunu, Rajasthan, inviting applications for MBBS and other medical courses. The institution has in its advertisement published in various newspapers claimed that Hon'ble High Court in the case of IGNOU has held that there is no provision in the Indian Medical Council Act which authorises and empowers BoG-MCI to grant permission or recognition to IGNOU to enable it to take admission and impart education in MBBS and other medical courses.

On this, the apex medical council has stated that the varsity mischievously claims that it is covered by a judgment of Hon'ble High Court without referring to the cause title and the Hon'ble Court that has pronounced it. Such a claim is frivolous, baseless and is made in complete violation of law made by Parliament.

Pointing out that this claim stands in violation of the IMC act and the admissions made by the varsity will be considered as void, the MCI BoG warned the aspirants:

"It may be noted that the claim so made by the Singhania University is in violation of the provisions of the Indian Medical Council Act, 1956 and the Regulations framed thereunder. Accordingly, any admissions that are made by the Singhania University, Pacheri Bari, Distt. Jhunjhunu, Rajasthan in the courses of medicine (MBBS) is illegal and void ab initio."

Last year as well, the MCI had issued a similar warning for the general public and medical aspirants seeking admissions to the varsity. The apex medical regulator had noted that all courses including MBBS, diploma and Doctor of Medicine courses were being run without MCI permission and in particular, it had debunked the university claim referring to certain HC judgement that the state medical council have to recognise such degrees.

At that time, it had come to the notice of the Board of Governors of MCI that Singhania University was running courses, such as MBBS; Doctor of Medicine course in Pharmacology, Anatomy, Biochemistry, Physiology, General Medicine, Obstetrics and Gynecology, Ophthalmology, Pathology, Community Medicine and Dermatology; and Diploma courses in Anesthesia, Obstetrics and Gynecology, Immuno- Hematology and Blood Transfusion, Oto-Rhino-Laryngology, and Radio-Diagnosis. The said institution had claimed that as per Punjab & Haryana High Court Judgment (following Supreme Court Judgment) in Neelam Devi case, State Medical Council/any other concerned Council shall have to recognize the degree/ diploma/certificate awarded by University ad shall have to enroll the degree holder to enable him/leer to do practice.

Concerned with these violations hampering the interest of students, the MCI reiterated the provisions of the IMC act clearly stating that running modern medicine, namely, MBBS, or Diploma in various streams of medicine; MD/MW/DM/M.Ch without the prior permission of the Central Government/ Board of Governors of MCI is illegal.

"It is hereby informed that under the provisions of the Indian Medical Council Act, 1956 prior permission of Central Government is required to establish a new Medical College and impart courses in modem medicine. Such permission is granted by the Central Government on the recommendation of the Medical Council of India. The admissions made by any Institution that imparts courses in modern medicine, namely, MBBS, or Diploma in various streams of medicine; MD/MS/DM/M.Ch without the prior permission of the Central Government is illegal and students so admitted shall not get recognized medical qualification entitling them to practice medicine."

By way of the notice signed by Dr RK Vats, Secretary-General at MCI BoG, the council informed all concerned not to be misled by the advertisement issued by the Singhania University, Pacheri Bari, Distt. Jhunjhunu, Rajasthan. All students/parents/general public are advised to check the status of Medical Colleges before taking admission in any of the Medical Colleges.
