Bombay HC refuses to stay MUHS final year MBBS exams via physical mode from September 8

The university announced that the exams will be held from September 8 and almost 9500 UG medicos will be appearing for the final year examination from 245 centres of the state. MUHS has more than 300 colleges under it.

Previously, concerned student unions and organizations had also moved the court seeking cancellation of final year exams but the court had declined to issue a stay order. Medical Dialogues had reported that the final-year postgraduate medical (PG medical) and dental students also wanted to defer the exams and approached the Bombay High Court for the same but the court denied interim relief and clarified that final exams, scheduled to be conducted by the Maharashtra University of Health Sciences (MUHS) for dental and medical students would be held in August.

Then, the 9 aggrieved medicos approached the court and filed the petition to essentially seek withdrawal of an August 21, 2020 circular issued by the varsity and stay the holding of final year medical examinations across the state.

The counsel appearing on behalf of the students sought that the exams be postponed due to the pandemic the "unpreparedness'' of authorities in holding the exams at present. The students wanted the state to take a decision to extend the date.

The state through its government pleader left it to the discretion of MUHS as they said it was the best judge of the situation.

Deliberating on the issue, the bench of honourable justices Amjad Sayed and SP Tavade said the petitioners, nine students, "have approached this court at the eleventh hour.''

"The Petition itself discloses that there are about 10,000 students who are to appear in the physical examination mode,'' said the HC. The HC also noted that the Supreme Court while dismissing petitions seeking postponement of NEET 2020 and JEE (Main) in its August 17 order had found that there "is absolutely no justification in the sprayer made for postponement of the examinations.''

The SC had noted, "though there is a pandemic situation, but ultimately life has to go on and the career of students cannot be put on peril for long and full academic year cannot be wasted.

The HC thus posted the students petition for further hearing on September 17.
