NMC introduces amendments in Establishment of Medical Colleges Regulations, invites comments
New Delhi: Introducing changes in the rules for establishing medical colleges, the National Medical Commission (NMC) has released the Draft Establishment of Medical College Regulations, (Amendment), 2022.
The universities and deemed-to-be-universities will be benefitted by these amended rules which aim to change the previous norms as mentioned in the Establishment of Medical College Regulations, 1999.
As per the amended qualifying criteria for setting up medical colleges, now the Universities or deemed to be universities will not be required to fulfill the condition of "fully functional hospital for a minimum of 2 years".
However, such a relief has been given to them on the condition that the building of hospital and the medical college are owned and managed by the same organization, the proposed building of the medical college has not been used for any other purpose, at the time of application, the institute has an established multi-specialty hospital with at least 1000 in-patient beds.
Informing about this, the NMC notice dated September 19, 2022 stated, "The National Medical Commission is considering an amendment to the Establishment of Medical College Regulations, 1999."
Inviting public comments on the amended regulations, the Apex medical body further mentioned in the Public Notice, "The Public Comments on the Draft Establishment of Medical College Regulations, (Amendment), 2022 as per Section 57 of the NMC Act, 2019 may be shared at the following e-mail ID — ugmebnmc.org.in in MS Word (.docx) format or machine readable PDF format within 30 days of publishing of this notice."
As per the NMC notice, these regulations have been amended in compliance with the Union Health Ministry's direction. In this regard, NMC mentioned, "In exercise of the powers conferred by Section 57 read with Sub-Section 1 of Section 24 of the National Medical Commission Act, 2019 (30 of 2019) and in compliance with the direction issued by Ministry of Health & Family Welfare vide letter dated 23rd Aug, 2022 under Section 45 of the National Medical Commission Act, 2019, the National Medical Commission hereby makes the following Regulation to further amend the "Establishment of Medical College Regulations, 1999" namely..."
The modified qualifying criteria, as mentioned in the amended regulations states-
"In clause 2(5A), under the heading "QUALIFYING CRITERIA", the following shall be added:-
The condition of 'fully functional hospital for a minimum period of 2 years' shall not apply in case of Universities or deemed to be universities within the meaning of University Grants Commission Act, 1956, having experience of establishing and running fully functional recognized medical colleges and hospital of 1000 beds or more, for at least two years, anywhere in India, provided that:-
(i) The building of both the hospital and the medical college is owned and managed by the same organization.
(ii) The building of the proposed medical college has not been used for any other purpose before making an application to the Medical Assessment and Rating Board (MARB) of National Medical Commission (NMC) for establishment of new medical colleges, and
(iii) At the time of application, has an established multi-specialty hospital with at least 1000 in-patient beds and fulfilling all other norms under the regulation."
