NMC Withdraws Previous Decision of Cancelling MBBS Admissions at Radha Devi Jageshwari Memorial Medical College after HC Order

New Delhi: Following the Patna High Court's order issued earlier this year, the Medical Assessment and Rating Board (MARB) of the National Medical Commission (NMC) has now withdrawn its previous decision of withdrawing the letter of permission granted to Radha Devi Jageshwari Memorial Medical College and cancelling 150 MBBS admissions for the academic year 2021-2022.

Apart from this, the NMC Medical Assessment and Rating Board has also withdrawn its order dated 05.07.2023 through which the Commission had withheld the permission for the 3rd batch (2nd renewal) for those 150 MBBS seats at the medical college for the academic year 2023-2024.

After granting permission to the medical college for MBBS admission first time for the academic year 2021-2022, the National Medical Commission (NMC) later withdrew the same, after conducting a surprise inspection in the medical college. Consequently, the medical college and the society managing it, challenged the cancellation of permission to start the MBBS course.

Meanwhile, students were admitted to the medical college by the State Board. These students sought to be shifted to gov ernment medical colleges as they would be deprived of continuing their studies because of the cancellation of permission.

After a Single Judge bench of the Patna High Court stayed the NMC decision of cancelling the admission, NMC challenged the decision before a Division bench of the Court.

Medical Dialogues had earlier reported that while considering the matter, the Division bench of the Patna High Court had noted that even though the permission was granted for the academic year 2021-2022, because of the pandemic, the admission process for the year commenced only by 15.01.2022.

Noting that the students admitted on 18.04.2022, carried out their first-year course in the academic year 2022-2023, for which the college had a valid permission from NMC, the Court had held admissions of the students, made through the counselling by the State's board, were legally valid.

Following the High Court's order, NMC recently in a written communication directed to the Dean/Principal of the concerned medical college informed about the withdrawal of its earlier decision of cancelling MBBS admissions at the medical college.

"I am directed to refer to judgement pronounced by Hon'ble High Court of Patna (Bihar) dated 21.02.2024 in the case of National Medical Commission vs Radha Devi Jageshwari Memorial Medical College & Hospital , LPA No 845 of 2023 in CWJC No 7058 of 2022 with connected matters and Judgement dated 03.08.2023 in CWJC No 10903 of 2023 with connected matters," NMC mentioned in the letter.

"In compliance of the above mentioned Judgements dated 21.02.2024 and 03.08.2023, the Medical Assessment & Rating Board (MARB) Order No NMC/UG/2020/000093 dated 18-04-2022 in respect of Radha Devi Jageshwari Memorial Medical College & Hospital regarding "Withdrawal of Letter of Permission, Cancellation of Admissions in 150 Undergraduate MBBS Course for the Academic Year 2021-22 with effect from 19-04-2021-22 and the Medical Assessment & Rating Board (MARB) Order No NMC/UGR/2023-24/Offline dated 05-07-2023 regarding "With-holding of permission for 3rd Batch (2nd Renewal) in respect of 150 MBBS seats for the Academic Year 2023-24", are hereby withdrawn," the letter further added.
