HC seeks NMC's response on cancellation of 150 MBBS, 39 PG seats at Mahavir Institute of Medical Sciences

Hyderabad: The Telangana High Court recently sought to know the stand of the National Medical Commission (NMC) while considering a plea by the Mahavir Institute of Medical Sciences (MIMS), which recently lost permission for 150 MBBS and 39 PG medical seats following a surprise inspection by the Apex Medical body.

Seeking response from the Commission, the HC bench comprising of Chief Justice Satish Chandra Sharma and Justice Abhinand Kumar Shavili directed the NMC counsel to obtain instructions and adjourned the matter till Wednesday.

Medical Dialogues had earlier reported that following a surprise inspection, the National Medical Commission (NMC) recently cancelled MBBS and PG medical admissions in three private medical colleges in the State resulting in a huge decrease in the total number of seats.

While MBBS and postgraduate courses has been cancelled at MNR Medical College and Hospital, Sangareddy, in the case of Mahavir Institute of Medical Sciences, Vikarabad, the Apex Medical Regulator has cancelled the PG medical seats.

Apart from this, TRR Institute of Medical Sciences, Patancheru has lost its letter of permission for the first renewal and second batch of admission.
Such a decision has been taken by the Apex Medical body on the basis of the surprise inspection conducted by the team on March 30, 2022. Although NMC did not act on the inspection reports before admission into UG and PG courses were being conducted until May first week, it cancelled the admissions on May 19 after the process was completed.

Recently, the State Government intervened to solve the matter and set up a high-level committee as well. Apart from this, it also wrote to the NMC and assured giving directions to the medical colleges to rectify their mistakes.
Meanwhile, TRR Institute of Medical Sciences approached the High Court and prayed for a stay on the order of the Apex medical body. Consequently, the vacation bench of HC out a stay on the NMC order of cancelling admission of 150 fresh candidates at the TRR Institute of Medical Sciences until the Apex Medical Body takes a call on the statutory appeal filed by the aggrieved college.
In case of the Mahavir Institute of Medical Sciences (MIMS), the NMC conducted a surprise check and citing lack of necessary facilities, it cancelled 150 MBBS and 39 PG admissions in the Institute. Challenging the order, the institute appealed before the NMC Committee and also approached the Supreme Court. Apart from this, the Institute has also appealed before the HC seeking directions upon the NMC so that no coercive action is taken against the institute during the pendency of the statutory remedies available to the institute.

Alleging 'unilateral cancellations' on the part of NMC, the counsel for the institute, Senior attorney D Prakash Reddy argued that the Medical Assessment and Rating Board (MARB), which had imposed the cancellation, can only make recommendations for revoking the permit and it cannot immediately impose cancellations.
"This board has only powers to recommend for withdrawal of the permission and it cannot straightaway order cancellations," he submitted.
The counsel for the college also pointed out how the authorities were satisfied with the infrastructure a few months back when they had given it the permission for MBBS and PG medical admissions.
On the other hand, the counsel for NMC, Gorantla Sriranga Pujitha claimed that the Institute severely lacked essential facilities for running a medical school. Referring to the fact that it has been five years since the college initiated its operations, the counsel alleged that the same flaws have persisted throughout the years.
TOI adds that she further assured, "We will not take any coercive steps till the NMC committee takes a decision on the appeal filed by the college."
As per the latest media report by the New Indian Express, taking note of the submissions, the HC bench directed the NMC counsel to get directions from the Apex Medical Body regarding the matter.
Adjourning the matter till Wednesday, the HC bench also clarified that the Supreme Court had asked all the courts not to pass interim directions in matters concerning medical admission process.
