Rs 10 lakh penalty for discontinuing PG medical course in Karnataka

Bengaluru: Students getting admitted to postgraduate medical or dental degree courses in Karnataka will have to furnish a bond in the form specified by the Government, binding themselves to pay Rs 10 lakh as a penalty in the event of his leaving the course before its completion after the last date of admission for that academic year, as notified by the National Medical Commission or Dental Council of India.

For the students taking admission to postgraduate medical or dental diploma courses in Karnataka, the amount of seat-leaving bond penalty is Rs 4 lakh.

The seat-leaving bond rules for the PG medical and dental courses were specified by the Karnataka Examinations Authority (KEA) in the e-Information Bulletin for admission to Post-Graduate Medical / Dental Courses for the year 2025.

These rules not only specify the amount of seat leaving bond penalty, but also the rules regarding forfeiture of seats selected during counselling.

Forfeiture of seats selected during counselling.-

(1) If a candidate cancels a seat in the first round after admission, one day before the second round of counselling as notified, he/she shall be liable to pay a processing fee of Rs 25,000/- (Rupees twenty five thousand only).

(2) All the candidates (including the in-service candidates) will have to pay Rs 1,50,000 (Rupees one lakh fifty thousand only) for Medical or Dental Degree and Rs. 60,000/- (Rupees sixty thousand only) for Medical or Dental Diploma courses if he / she is allotted any clinical seat in the second-round allotment and fails to join the course before the last date of joining of the second round of counselling as notified.

(3) Further, the candidates shall be ineligible for further rounds of counselling or admissions for that academic year. The norms also specified that in case of cancellation after the last date of joining for the second round and one day before the mop-up round, a penalty of Rs 7,00,000 (Rupees Seven lakhs only) for Medical or Dental Clinical degree and Rs.3,00,000/- (Rupees Three lakhs only) for Medical or Dental Clinical Diploma courses shall be collected.

(4) As per the rules, any cancellation or surrender of seats after the mop-up round shall be made in person only to the Director, Directorate of Medical Education, Karnataka with a penalty of Rs 18,00,000/- (Rupees eighteen lakhs only) in case of Medical Clinical Degree or Diploma Courses and Rs 6,00,000/- (Rupees six lakhs only) in case of Dental Degree or Diploma Courses along with forfeiture of fees paid before the last date of admission as notified. Apart from this, the candidates will also be ineligible for further rounds of admission, including the names list admission.

The Bulletin also specified the specialty-wise penalty applicable to candidates. In this regard, the rules are as follows:

(a) A candidate who has opted for Pre-Clinical seats like Anatomy, Physiology, and Biochemistry, including Forensic Medicine shall pay a penalty of Rs 1,00,000 (Rupees One Lakh only) in the event of cancellation, along with forfeiture of the fees.

(b) In the event of cancellation, a candidate who has opted Para Clinical Seats like Pharmacology, Pathology, Microbiology and Community Medicine, shall pay a penalty of Rs. 2,00,000/- (Rupees Two lakhs only) for post graduate degree courses and Rs. 75,000/- (Rupees Seventy thousand only) for post graduate Diploma courses and the tuition fees paid shall be forfeited.

In this regard, the rules further specified that if a non-in-service/regular candidate, cancel/surrender a Medical/Dental Postgraduate degree or diploma seat after the last date of admissions, he/she will not be eligible to take admission under the management quota seat or any other quota Medical or Dental PG Degree or Diploma seat for a period of three years.

Further, in case a non-in-service / regular and in-service candidate cancel/surrender the seat before or after the last date of admission / counselling, he / she shall not be permitted/eligible for rejoining the cancelled/surrendered seat. If such a candidate fails to join the course after allotment, he/she shall not be eligible to take management quota seat or any other Medical or Dental PG degree or Diploma seat for a period of three years and shall be liable for disciplinary action.

(5) As per the bulletin,

"A candidate at the time of admission shall furnish a bond in the form specified by the Government binding himself to pay a sum of Rs. 10,00,000/- (Rupees Ten lakhs only) for Medical or Dental degree and Rs. 4,00,000/- (Rupees four lakhs only) for Medical or Dental Diploma courses as a penalty in the event of his leaving the course before its completion after the last date of admission for that academic year as notified by Medical Council of India/Dental Council of India."

In this regard, the rules also specified the specialty-wise penalty rules, which are as follows:

(a) In the event of leaving the course, a candidate who has opted for Pre-Clinical seats like Anatomy, Physiology, and Biochemistry, including Forensic Medicine, shall pay a penalty of Rs.1,00,000/- (Rupees One Lakh only) and the fees paid shall be forfeited.

(b) A candidate who has opted Para Clinical seats like Pharmacology, Pathology, Microbiology, and Community Medicine shall pay a penalty of Rs 1,00,000 for post-graduate degree courses and Rs 75,000 for post-graduate Diploma courses in the event of cancellation, and the tuition fees paid shall be forfeited.

(6) Additionally, the rules mentioned that in addition to the prescribed penalty under sub-rule (4), all candidates (including in-service candidates) shall pay the entire course fee and stipend to the respective Medical/Dental colleges in the event he leaving the course before its completion.

Under the rules, if an in-service candidate leaves the course before its completion or the competent authority concludes that the in service candidate has not shown sufficient progress in the studies or has failed to complete the course in proper time or if the candidate fails to resume duty even after the expiry of the termination of the period of deputation or at any time within a period of ten years after completion of the higher studies, it shall be lawful to the Government to make recovery of the amount (including pay and allowances, stipend, DA, tuition fee etc, along with penalty and applicable interest) spent on higher studies or specialized training from the salary of the candidate.

(7) All Candidates selecting Government seats {including All India quota (AIQ) in Post Graduate Medical Courses shall furnish an undertaking that he / she shall serve the Government for a minimum period of three years after completion of the course, if Government desires.

At the time of admission, the in-service candidates shall furnish a bond in the form specified by the Government that they shall be rendering service in the Government for a minimum period of ten years.

(8) If a candidate selects Government seats, the candidate shall serve the Government for a period as specified in sub-rule (6) failing to comply, with the conditions given as per undertaking, then he / she shall be liable to pay a penalty of Rs. 50,00,000/- (Rupees fifty lakhs only) in case of Post Graduate Medical degree and Rs. 25,00,000/- (Rupees twenty five lakhs only) in case of Post Graduate Medical Diploma to the Government.

(9) Any cancellation or surrender shall be done at the Directorate of Medical Education after the last date of admission for that academic year.

"The candidates are advised to strictly adhere to the above said rules. Lenience in any matter explained above will not be entertained. The Government/Department of Medical Education / KEA hold all the powers to cancel the candidature of candidates who do not comply with the rules and regulations. Admission to PG Medical and PG Dental seats shall be made in accordance with the Karnataka Conduct of Entrance Test for selection and admission to Post Graduate Medical and Dental Degree and Diploma courses Rules, 2006 (Amendments) as amended from time to time and therefore the details and instructions contained in this Information Bulletin are subject to the said Rules and Government orders. In case of any discrepancy, the Rules shall prevail," mentioned the Bulletin.
