SC to Hear Plea Demanding JIPMER Roster Model for AIIMS Admission On January 24

New Delhi: The Supreme Court has recently adjourned a batch of pleas demanding JIPMER Roster Model for Institutional Preference in AIIMS PG Admissions for two weeks.

After directing the respondents including AIIMS to file counter affidavits, the top court bench comprising of Justices LN Rao and BR Gavai has listed the matter for further hearing on January 24, 2022.

This comes after Students Association of AIIMS Bhopal approached the top court and sought a defined criterion for determining the seat matrix for the institutional preference candidates in the INI-CET examination. Further, the plea requested for roaster-wise/ discipline wise seat allocation for institutional preference candidates seeking admission via the INI-CET entrance test.

The petition was filed by Advocate Charu Mathur and the petitioners were represented by Dubey Law Associates. The plea argued that the students were facing troubles and hardships due to the fact that there was no defined mechanism for seat allocation to those coming from the Institutional preference route.

Resultantly, the students were unable to secure seats in the desired/sort after disciplines. In fact, even when the students were eligible, they were deprived of institutional preference.

The plea averred that it is imperative to direct the Respondents for providing the exact distribution of seats clarifying how the 50% criteria for Institutional preference are met by them.

As per the latest media report by Live Law, when the matter came up for hearing on Monday, the counsel for the petitioners submitted that the petitioners were waiting for the response from AIIMS.

Taking note of this submission, the presiding judge of the bench Justice LN Rao asked Advocate Dushyant Parashar, the counsel for AIIMS if the respondents were willing to file a response.

"Do you want to file a response or are you ready to argue the matter? PG admissions have to start and we've to hear the matter immediately," the Bench asked.

Senior Advocate Arvind Datar, appearing on the behalf of the petitioners, submitted that the institute had got a legal opinion as per which they were willing to comply with the roster system. However, AIIMS was looking for an order from the top court clarifying the same.

"In JIPMER system there is a roster system. AIIMS have got a legal opinion but they don't want to do anything contrary to what the SC has said. Just want the order clarifying that they can comply with the roaster system," he submitted before the top court.

Responding to this, the bench asked Advocate Parashar to get instructions on the same and file an affidavit regarding the same.

"Students who are your students are not getting the branch of studies which they want. You get instructions and we will list it on Monday. So far as your institutions are concerned, when is the counselling for PG? Is there any date given? You file the reply. We will list the matter after 2 weeks," Justice Rao was quoted saying by Live Law.

Even though the counsel for the petitioners requested an early hearing of the matter next Wednesday, the bench pointed out that there were too many cases and adjourned the matter for a further hearing on January 24, 2022.
