BHMS Graduate Uses MBBS Doctor's Credentials for Manning ICU, Arrested

Mumbai: Police have arrested a Bachelor of Homeopathic Medicine and Surgery (BHMS) graduate for allegedly using the registration number and name of an MBBS doctor.

According to Mulund Police, using the credentials of an MBBS doctor Dr Maurya, the 30-year-old BHMS graduate Jadhav was allegedly manning the ICU at the MT Agarwal Hospital. Dr Maurya was unaware of the fact that his name and registration number were being used by someone else.

The arrested BHMS graduate was practicing at MT Agarwal Hospital from February 2022 to August 2022. It has been revealed that the doctor had issued four death certificates using the name and registration of Dr. Maurya. The BHMS graduate, who has been detained by police, is to remain in police custody till Tuesday.

As per the latest media report by Hindustan Times, last month a case was registered against the six trustees of Jeevan Jyoti Charitable Trust for allegedly recruiting unqualified and bogus doctors to man the intensive care units (ICU) of MT Agarwal Hospital and the recent arrest of the BHMS graduate on Saturday is the third such arrest in respect of the case.

The arrested doctor pursued his BHMS degree from Satara and was staying in Kalyan. Deputy Commissioner of Police of Zone 7 Purshottam Karad has informed the daily that the arrested doctor was using Dr. Maurya's name and registration number without his knowledge.

A police officer, who is a part of the investigating team informed that earlier two other persons were arrested in this connection. Someone named Chandrashekhar Bhulairam Yadav was working as a coordinator in the hospital and using the name of another person known as Dr Chandrashekhar Ramdular Yadav. Another person Surekha Chavan, who was also arrested, previously worked as a doctor between 2020 to 2022.

The police officer informed that Chandrashekhar Bhulairam Yadav was enrolled in an MBBS course in China. However, he had to return to Mumbai due to COVID-19 lockdown and started practicing in MT Agrawal Hospital even though he didn't complete his medical degree.

Deputy Commissioner of Police of Zone 7 Purshottam Karad informed TOI that while Yadav completed his MBBS from China in June 2022, he had not registered with Maharashtra Medical Council (MMC). The officer added that Yadav had allegedly issued 32 death certificates.

The matter came to light after a social activist Goldy Sharma found out that several doctors at the hospital's ICU were not properly qualified and lacked registration with the Maharashtra Medical Council (MMC). When Sharma filed a complaint suspecting the credibility of the doctors, an order was issued by the court and on the basis of this a case was registered.

The activist had requested information regarding the qualifications of the on-duty doctors in the ICU. Further, the data regarding the number of deaths in the ICU between February 17, 2018, and November 22, 2018, was also sought by the activist.

The statement by Sharma to the police mentioned, “I was told that 149 patients had died in the ICU of the hospital in this duration. Among the doctors that I was told were on duty, one Dr. Pervez Sheikh Aziz had been booked by Malvani police in 2020 for practising on a fake MMC license and by Thane police on some other charges."

Sharma had mentioned that he found out that two other doctors at the ICU, Dr. Prasad, and Dr. Rajesh lacked MMC registrations. On the basis of the complaint, a case was registered under sections 112 (Abettor when liable to cumulative punishment for act abetted and for act done), 117 (Abetting commission of offence by the public or by more than ten persons), 120-B (criminal conspiracy) 302 (punishment for murder), 307 (attempt to murder), 416 (cheat by personation), 419 (Punishment For Cheating ), 426 (Whoever commits mischief), 465 (Punishment for forgery), 471 (Whoever fraudulently or dishonestly uses as genuine any document which he knows or has reason to believe to be a forged) of the Indian Penal Code and the relevant section of Maharashtra Medical Practitioners Act.
