MD Physician running lab through DMLTs, treating on basis of their reports suspended for two months
Maharashtra: In a shocking case, the Maharashtra Medical Council (MMC) has suspended the registration of a senior MD doctor for two months after the council found that the doctor has been running an in-house pathological laboratory which was operated by a DMLT technician. It was revealed that the doctor was referring patients to the laboratory and was also treating them on the basis of the reports.
The suspension came after the council found that there were no qualified pathologists in the lab to supervise and the laboratory was maintained by a DMLT technician.
The order stated, " RMP accepted his guilt that he is treating patients on the basis of a technician's report. Secondly, evidence shows that the technician also running the laboratory on his premises."
The Ethics committee in the order noted
Thus, for the gross violation of professional misconduct and code of ethics as enumerated under Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulation 2002, R/W section 22 of MMC Act. 1965 and charged under article 1.1.1, 1.1.2, 1.2.1, 1.9 of chapter 1 of Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulation 2002 as well as failed to maintain the dignity of the profession. Thus, failed to observe the law of the country in regulating practice of medicine. Also, failed to observe the provisions of the state and violated the guidelines of apex court in the subject."
Therefore the council has sentence to remove the registration number 6***1 of Dr.*** (respondent) for 2 months from the Register of the Council from the date of the order. This said punishment of removal of registration shall be implemented after the appeal period are over.
